R-78-15 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, TO APPROVE SERVICE AND NONDISCLOSURE INTER -UTILITY <br />AGREEMENT BETWEEN SOUTHERN CALIFORNIA GAS COMPANY (SOCAL <br />GAS) AND COLTON ELECTRIC DEPARTMENT (CED) <br />WHEREAS, It is recommended that the City Council approve entering into a service <br />and non -disclosure inter -utility agreement between SoCal Gas Company and CED for an income <br />qualified energy efficiency mobile home retrofit program and authorize the City manager to <br />execute the agreement; and <br />WHEREAS, SoCal Gas Company enters into an agreements pursuant to Division 11 of <br />the California State Water Code to establish working relationships between other utilities to <br />share certain customer information in order to better serve the needs of low income customers <br />within SoCal Gas Company's service territories. SoCal Gas Company manages the delivery of <br />its Energy Savings Assistance Program (ESAP); and <br />WHEREAS, CED would reimburse SoCal Gas Company for services provided by <br />SoCal Gas to income qualified residential customers in the service territory of CED. CED would <br />be able to claim energy and water savings from this partnership while providing a valuable <br />service to mobile home owners in need of EE retrofits; and <br />WHEREAS, California Assembly Bill 1890 requires municipal electric utilities to <br />collect revenues for the following Public Benefit Programs: <br />Cost effective demand side management services to promote energy efficiency and <br />energy conservation; (2) new investments in renewable energy resources and technologies <br />consistent with existing statutes and regulations which promote those resources and <br />technologies; (3) research, development and demonstration programs for the public interest to <br />advance science or technology which is not adequately provided by competitive and regulated <br />markets; (4) services provided for low income electricity customers, including but not limited <br />to, targeted energy efficiency services and rate discounts; and <br />WHEREAS, In 2005, the California Legislature passed Senate Bill (SB) 1037 requiring <br />publicly owned utilities (POU) to report kilowatt (kWh) savings to the California Energy <br />Commission (CEC) annually. In 2006, Assembly Bill (AB) 2021 was approved requiring <br />publicly owned electric utilities to identify, target and achieve all potentially cost-effective <br />electricity savings. In February of 2015 AB 1330 was passed requiring CED to establish an EE <br />resource standard that would increase the amount of EE resources of the utility so that the total <br />amount of incremental energy savings achieved in any given year amounts to not less than <br />specified amounts. The Colton Electric Department (CED) currently offers a wide variety of <br />residential and commercial energy efficiency rebate programs in an effort to achieve the <br />mandated goals of AB 2021. Staff recommends that by entering into an inter -utility agreement <br />with SoCal Gas Company, CED will be able to achieve the kWh savings to meet an EE goal <br />
