R-92-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, APPROVING A MEMORANDUM OF UNDERSTANDING FOR PARTICIPATION IN THE SAN BERNARDINO COUNTY RECYCLING MARKET DEVELOPMENT ZONE WHEREAS, the California Public Resources Code Section 42010 provides for the establishment of the Recycling Market Development Zone ("RMDZ") program throughout the state to provide incentives to stimulate development of post -consumer and secondary materials markets for recyclables; and WHEREAS, cities and counties must meet a 50 percent reduction in landfill waste disposal as mandated in the California Integrated Waste Management Act; and WHEREAS, the San Bernardino County Recycling Market Development Zone ("SBCRMDZ") is dedicated to establishing, sustaining, and expanding recycling -based manufacturing businesses, which is essential for market development and to assist local jurisdictions to meeting the established landfill reduction goals; and WHEREAS, the City Council of the City of Colton approved Resolution R-07-13 on March 5, 2013, supporting the renewal, boundary adjustment and expansion of the new SBCRMDZ, of which the City of Colton is a participating jurisdiction; and WHEREAS, the SBCRMDZ shall include the County of San Bernardino and the cities of Colton, San Bernardino, Yucaipa, Ontario, Rancho Cucamonga and Rialto; and WHEREAS, the County of San Bernardino will serve as the Central Zone Administrator, responsible for Zone administration and oversight; and WHEREAS, the City of Colton desires that existing and new recycling -based manufacturing businesses locating within the region to be eligible for the technical and financial incentives associated with the RMDZ program; and WHEREAS, the City of Colton finds that current and proposed waste management practices and conditions are favorable to the development of post -consumer and secondary waste materials markets; and WHEREAS, pursuant to Californian Public Resources Code section 42010(b), the City of Colton finds that the designation as a recycling market development zone is necessary to assist in attracting private sector recycling investments to the area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Colton, as follows: SECTION 1. The recitals and findings preceding this Resolution are true and correct and are incorporated into this Resolution by this reference.
