R-92-15 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, APPROVING A MEMORANDUM OF UNDERSTANDING <br />FOR PARTICIPATION IN THE SAN BERNARDINO COUNTY RECYCLING <br />MARKET DEVELOPMENT ZONE <br />WHEREAS, the California Public Resources Code Section 42010 provides for the <br />establishment of the Recycling Market Development Zone ("RMDZ") program throughout <br />the state to provide incentives to stimulate development of post -consumer and secondary <br />materials markets for recyclables; and <br />WHEREAS, cities and counties must meet a 50 percent reduction in landfill waste <br />disposal as mandated in the California Integrated Waste Management Act; and <br />WHEREAS, the San Bernardino County Recycling Market Development Zone <br />("SBCRMDZ") is dedicated to establishing, sustaining, and expanding recycling -based <br />manufacturing businesses, which is essential for market development and to assist local <br />jurisdictions to meeting the established landfill reduction goals; and <br />WHEREAS, the City Council of the City of Colton approved Resolution R-07-13 on <br />March 5, 2013, supporting the renewal, boundary adjustment and expansion of the new <br />SBCRMDZ, of which the City of Colton is a participating jurisdiction; and <br />WHEREAS, the SBCRMDZ shall include the County of San Bernardino and the <br />cities of Colton, San Bernardino, Yucaipa, Ontario, Rancho Cucamonga and Rialto; and <br />WHEREAS, the County of San Bernardino will serve as the Central Zone <br />Administrator, responsible for Zone administration and oversight; and <br />WHEREAS, the City of Colton desires that existing and new recycling -based <br />manufacturing businesses locating within the region to be eligible for the technical and <br />financial incentives associated with the RMDZ program; and <br />WHEREAS, the City of Colton finds that current and proposed waste management <br />practices and conditions are favorable to the development of post -consumer and secondary <br />waste materials markets; and <br />WHEREAS, pursuant to Californian Public Resources Code section 42010(b), the <br />City of Colton finds that the designation as a recycling market development zone is <br />necessary to assist in attracting private sector recycling investments to the area. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Colton, as follows: <br />SECTION 1. The recitals and findings preceding this Resolution are true and correct <br />and are incorporated into this Resolution by this reference. <br />
