R-91-14 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />TO AMEND THE FISCAL YEAR 2014/2015 BUDGET TO <br />APPROPRIATE $125,000 FOR THE PURCHASE OF TAX DEFAULT <br />PARCEL 0163-362-12 FROM THE COUNTY OF SAN BERNARDINO <br />FOR USE AS A PARK FACILITY. <br />WHEREAS, property taxes in the County of San Bernardino ("County") that are <br />unpaid become a lien against the property; and, <br />WHEREAS, the County has the authority to sell/auction parcels of land located in the <br />County, on which property taxes have not been paid for five (5) years to satisfy the property <br />lien; and, <br />WHEREAS, Assessor's Parcel Number ("Parcel") 0163-362-12 is located within the <br />City of Colton ("City"), and has a lien of approximately $117,500 in unpaid taxes and fees, <br />and is available for auction by the County; and, <br />WHEREAS, the County has the authority to sell tax default parcels to a public entity <br />for a public use, prior to a scheduled auction date; and, <br />WHEREAS, the City Council has determined that the interests of the citizens of <br />Colton will be served by the creation of a park and sports facility in the City; and, <br />WHEREAS, the County has removed the Parcel from the upcoming auction to allow <br />the City of Colton to purchase the Parcel; and, <br />WHEREAS, the County of San Bernardino's Board of Supervisors must approve the <br />sale of the land to the City of Colton, should the Council determine that the purchase is for a <br />public use and is in the best interest of the City; and <br />WHEREAS, the City has the authority, and agrees to purchase the Parcel from the <br />County for the amount of the unpaid taxes. <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />DOES RESOLVE AS FOLLOWS: <br />SECTION 1. The City Council hereby finds and determines that the foregoing recitals <br />are true and correct. <br />
