CONDITIONS OF APPROVAL <br />EXHIBIT “A” <br /> <br />THE APPLICANT SHALL COMPLY WITH ALL CONDITIONS AS SET FORTH IN THE <br />CONDITIONS OF APPROVAL. <br /> <br />1. This approval is for a Conditional Use Permit (CUP) for the use of an 6,000- <br />square foot existing building as a storage warehouse for a stealth <br />telecommunication tower installation business, and Fence Review for a 6-foot <br />high chain link fence with beige-colored vinyl slats, including two driveway gates, <br />on a 0.48-acre property located at 1201 S. Lincoln Street (formerly 260 East <br />Adams Street) (APN 0254-0161-30), as shown on the plans stamped approved <br />on September 16, 2014, except as amended by the following conditions. <br /> <br />2. The Applicant shall defend, indemnify, and hold harmless the City of Colton and <br />its officers, employees, and agents from and against any claim, action, or <br />proceeding against the City of Colton, its officers, employees, or agents to <br />attacks, set aside, void, or annul any approval or condition of approval of the City <br />of Colton concerning this project, including but not limited to any approval or <br />condition of approval of the city council, planning commission, or development <br />services director. The City shall promptly notify the Applicant of any claim, action, <br />or proceeding concerning the project and the City shall cooperate fully in the <br />defense of the matter. The City reserves the right, at its own option, to choose its <br />own attorney to represent the City, its officers, employees, and agents in the <br />defense of the matter. <br /> <br />3. Conditions imposed on Architectural & Site Plan Review No. D-97-88 for a <br />proposed 6,000-square foot metal building at 260 Adams Street approved by the <br />Planning Commission on December 13, 1988 shall remain in effect, except as <br />specifically amended or superseded by these conditions. <br /> <br />4. Any requests for modifications, including any deviation from the approved plans <br />and/or conditions of approval, shall be submitted to the Development Services <br />Director for review, prior to implementation of the modification. Significant <br />deviations from the approved plans or conditions of approval shall be subject to <br />review and approval by the Planning Commission. The applicant requesting the <br />modification shall supply information deemed necessary by the Director and/or <br />Commission to make a determination. <br /> <br />5. Prior to the start of use of the building and/or site, the following shall be provided: <br /> <br />a) Obtain a Fence Permit from the Development Services Department for <br />the existing chain link fence, and payment of fees. <br /> <br />b) Final approval of a business occupancy permit (BOP) from the <br />Development Services Department, including the following:
