("CEQA'), City staff has determined that the proposed Laurel <br />Street Grade Separation Project is statutorily exempt from CEQA pursuant to Title 14 California <br />Code of Regulations Section 15282(g) (any railroad grade separation project which eliminates <br />an existing grade crossing or which reconstructs an existing grade separation as set forth in <br />Public Resources Code Section 21080.13); <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DOES HEREBY RESOLVE: <br />SECTION 1. Recitals. The City Council finds and determines that the recitals of facts <br />preceding this Resolution are true and correct and such recitals are incorporated into this <br />Resolution by this reference. <br />SECTION 2. CEQA Compliance. The City, as lead agency, finds and determines that <br />the proposed Laurel Street Grade Separation Project is statutorily exempt from CEQA pursuant <br />to Title 14 California Code of Regulations Section 15282(g) (any railroad grade separation <br />project which eliminates an existing grade crossing or which reconstructs an existing grade <br />separation as set forth in Public Resources Code Section 21080.13). The City Council directs <br />and authorizes the City Clerk to file a Notice of Exemption with the Clerk of the Board of <br />Supervisors of the County of San Bernardino, California, within five (5) days following the date <br />of adoption of this Resolution. <br />SECTION 3. Community Redevelopment Law Findings. Based on the facts set forth in <br />the recitals preceding this Resolution, the oral and written reports from City staff regarding the <br />Laurel Street Grade Separation Project and all other oral and written evidence provided to the <br />City Council regarding the Laurel Street Grade Separation Project, the City Council finds and <br />determines all of the following: <br />3.1. The Agency's payment of a portion of the City's costs of constructing and <br />installing the Laurel Street Grade Separation Project will be of primary benefit to each of the <br />Rancho Mill Project Area, the Mt. Vernon Project Area and the West Valley Project Area by <br />eliminating blighting conditions affecting all of the Proj ect Areas through improved public street <br />traffic operations, improved public safety, including pedestrian safety for students walking to <br />Colton Middle School from the Rancho/Mill and Mt. Vernon Project Areas, reduction in train <br />related noise impacts on area residents and reduction in air pollutant emissions from both trains <br />and traffic, that all impact the Rancho/Mill Project Area, the Mt. Vernon Project Area and the <br />West Valley Project Area because the Laurel Street Grade Separation Project is located within <br />the Rancho/Mill Project Area and within approximately 1,500 feet of the Mount Vernon Project <br />Area and within approximately 3,000 feet of the West Valley Project Area. A joint San <br />Bernardino Association of Governments and City study entitled "Laurel Street/BNSF Grade <br />Separation Project In the City of Colton SANBAG Project No. 883," approved on November 12, <br />2010 ("SANBAG Study"), further provides a detailed analysis of the impacts of the Laurel <br />Street Grade Separation Project. <br />23604.09000\5872287.1 <br />
