R-73-11 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON CERTIFYING THE ENVIRONMENTAL <br />IMPACT REPORT PREPARED FOR THE COLTON SOIL <br />SAFE PROJECT ("PROJECT"), ADOPTING <br />ENVIRONMENTAL FINDINGS PURSUANT TO THE <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT, <br />DENYING THE PROJECT BASED UPON THE NECESSITY <br />OF AVOIDING THE PROJECT'S SIGNIFICANT <br />ENVIRONMENTAL IMPACTS AND DENYING THE <br />APPEAL AND UPHOLDING THE PLANNING <br />COMMISSION'S DENIAL OF DAP 000-910 <br />WHEREAS, Soil Safe of California ("Applicant") filed an application (File No. DAP - <br />000 -910) requesting approval of a Conditional Use Permit to allow the placement of <br />approximately 500,000 cubic yards of engineered soil on approximately 29 acres to raise the site <br />out of the Santa Ana River floodplain (hereinafter "Project") on a site located at the southerly <br />terminus of Florez Street and Fernando Street legally described as Assessor Parcel Numbers <br />0163-362-11, 0163-362-12, and 0163-362-26 (hereinafter "Subject Property"); and <br />WHEREAS, it is the intent of the Applicant that the proposed Project would consist of <br />the import of soil and cement to be processed and placed on site over a duration of three to five <br />years resulting in a raised site with a new elevation between 5 and 20 feet above the existing <br />grade, and at finished grade would be relatively flat with a gentle slope toward an onsite <br />stormwater management basin and approximately 7 feet above the existing grade of the adjacent <br />properties to the north; and <br />WHEREAS, as proposed, the Project includes the use of a portion of the adjacent 17.5 - <br />acre City -owned property at the southeast corner of Congress Street And Fogg Street legally <br />described as APNs 0163-381-01 and 0163-381-02, parcels 22 and 23.for an access road, site <br />trailer and weigh scale ; and <br />WHEREAS, the General Plan designation of the Site is designated on the General Plan <br />Land Use Map as "OS" - Open Space and zoned "OS" - Open Space and at the completion of <br />construction the site would continue to be designated as Open Space; and <br />
