1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the Project has been considered and reviewed by the City Design Review <br />Committee and, on February 7, 2011, the Design Review Committee forwarded the Project to the <br />Planning Commission of the City of Colton ("Planning Commission") without recommendation, <br />due to the complexity of the project and the outstanding concerns about the Project's benefits to <br />the community, and offered the Planning Commission three choices and providing supporting <br />documentation for each choice; and <br />WHEREAS, on March 8, 2011, the Planning Commission conducted a duly noticed <br />public hearing on the Application at which time all persons wishing to testify in connection with <br />the proposed Application were heard, and the Application was comprehensively reviewed and <br />concerns were raised by the public, an adjacent property owner, and two responsible agencies <br />such that additional Staff analysis was required and the Planning Commission continued the <br />public hearing for 30 days until April 12, 2011; and <br />WHEREAS, following considerable discussion and public testimony regarding the <br />Project, the Planning Commission voted to deny the Project and to take no action on the <br />Environmental Impact Report, and <br />WHEREAS, subsequent to the Planning Commission's decision, a timely appeal of the <br />Planning Commission's denial was received by the City Clerk ("Appeal"); and <br />WHEREAS, on May 17, 2011 and June 21, 2011, the City Council of the City of Colton <br />("City Council") conducted a duly noticed public hearing on the Appeal at which time all persons <br />wishing to testify in connection with the Appeal were heard, and the Appeal was <br />comprehensively reviewed and considered; and <br />WHEREAS, evidence presented to the City Council during the Appeal included the <br />following: <br />-2- <br />
