As described in Section V and VI, the City Council also denies the Project <br />because it cannot make the findings for approval of the conditional use permit (DAP 000- 910) <br />required by Section 18.58.060(H) of the Colton Municipal Code and denies the Applicant the use <br />of the City -owned property for the Project. <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />RESOLVES AS FOLLOWS: <br />SECTION I. CERTIFICATION OF THE EIR BY THE CITY COUNCIL. <br />The City Council finds that it has been presented with the EIR, which it has reviewed and <br />considered, and further finds that the EIR is an accurate and objective statement that has been <br />completed in full compliance with CEQA and the State CEQA Guidelines and that the EIR <br />reflects the independent judgment and analysis of the City. The City Council declares that no <br />evidence of new significant impacts or any new information of "substantial importance" as <br />defined by State CEQA Guidelines section 15088.5 been received by the City after circulation of <br />the Draft EIR, which would require recirculation. Therefore, the City Council hereby certifies the <br />EIR based on the entirety of the record of proceedings and adopts as its findings the <br />determinations included therein and the findings contained in Sections lI and III of this <br />Resolution pertaining to the significant and unavoidable impacts of the Project and potential <br />alternatives to the Project. <br />SECTION II. SIGNIFICANT AND UNAVOIDABLE IMPACTS OF THE <br />PROJECT <br />Based upon the EIR and the entirety of the administrative record, the City Council finds <br />that the following impacts of the proposed Project will remain significant and unavoidable despite <br />the implementation of feasible mitigation measures. <br />A.
