As described in Section V and VI, the City Council also denies the Project because it cannot make the findings for approval of the conditional use permit (DAP 000- 910) required by Section 18.58.060(H) of the Colton Municipal Code and denies the Applicant the use of the City -owned property for the Project. WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON RESOLVES AS FOLLOWS: SECTION I. CERTIFICATION OF THE EIR BY THE CITY COUNCIL. The City Council finds that it has been presented with the EIR, which it has reviewed and considered, and further finds that the EIR is an accurate and objective statement that has been completed in full compliance with CEQA and the State CEQA Guidelines and that the EIR reflects the independent judgment and analysis of the City. The City Council declares that no evidence of new significant impacts or any new information of "substantial importance" as defined by State CEQA Guidelines section 15088.5 been received by the City after circulation of the Draft EIR, which would require recirculation. Therefore, the City Council hereby certifies the EIR based on the entirety of the record of proceedings and adopts as its findings the determinations included therein and the findings contained in Sections lI and III of this Resolution pertaining to the significant and unavoidable impacts of the Project and potential alternatives to the Project. SECTION II. SIGNIFICANT AND UNAVOIDABLE IMPACTS OF THE PROJECT Based upon the EIR and the entirety of the administrative record, the City Council finds that the following impacts of the proposed Project will remain significant and unavoidable despite the implementation of feasible mitigation measures.
