City Council Ordinance No. 0-09-17 <br />Page 3 of 4 <br />1 b. Location: <br />2 fD Electric fences shall be permitted only in the M-1 (Light <br />Industrial) and M-2 (Heavy Industrial) Zones of the Colton <br />3 Zoning Code and only at locations approved by the Development <br />4 <br />Services Department. <br />JQ Electric fences shall not be permitted within 50 feet of a <br />5 proper with a residential zone or use, a school site, or a park <br />site <br />6 <br />C. Height: Electric fences shall be limited to a height of 10 feet. <br />7 d. Warning Signs: Electric Fences shall be clearly identified with <br />g warning signs prepared in English and Spanish that read: <br />"Warning-Electric Fence" at intervals of not less than 60 feet. <br />9 C. "Knox Box": A "Knox Box Electrical Shunt Switch" and a <br />10 "Knox Box" or other similar approved device shall be installed <br />for emergency access of Police and Fire Departments. <br />11 4. Indemnification. All applicants issued permits to install or use an <br />12 electric fence as provided in this Chapter shall agree, as a condition of <br />ep rmit issuance, to defend, indemnify and hold harmless the City of <br />13 Colton and its agents, officers, consultants, independent contractors and <br />employees from any and all claims actions or proceedings arising out of <br />14 any personal iniury, including death, or property damage caused by the <br />15 <br />electric fence. <br />5. Emergency Access. In the event that access by the City of Colton Fire <br />16 Department and/or Police_ department personnel to a property where a <br />17 permitted electric fence has been installed and is operating, is required <br />due to an emergency or urgent circumstances, and the Knox Box or <br />18 otber similar approved device referred to in this Chapter is absent or <br />non-functional, and an owner, manger, employee, custodian or any <br />19 other person with control over the property is not present to disable the <br />electric fence the fire or police personnel shall be authorized to disable <br />20 the electric fence in order to gain access to the property. <br />21 A-. B. Barbed wire Fences or Fences with sharp prongs May be placed on grazing land or <br />along section lines. <br />22 &C. Barbed wire or sharp prongs May be placed atop a Fence which protects a storage or <br />23 public Utility Yard. <br />24 G. Fenees with less than one hundred volts Maybe placed in Agr-iudltufal zones <br />for- the keeping of animak <br />25 <br />SECTION 5. If any sentence, clause or phrase of this Ordinance is for any reason held to <br />26 be unconstitutional or otherwise invalid, such decisions shall not affect the validity of the remaining <br />provisions of this Ordinance. <br />27 <br />SECTION 6. The City Council hereby finds and determines that it can be seen with <br />28 certainty that there is no possibility that this Ordinance may have a significant adverse effect on the <br />-3- <br />
