Colton Ordinance No. 0-11-17
<br />1 WHEREAS, this Ordinance would amend Chapters 18.06.060 and 18.48.130 and add
<br />Chapter 18.48.134 to the Colton Development Code to regulate commercial marijuana cultivation
<br />2 to promote health, safety, and general welfare of the citizens of the City and to reduce the risks
<br />3 associated with large scale marijuana cultivation to an acceptable level to allow such a use in the
<br />City;

<br />WHEREAS, this Ordinance would amend the Official Zoning Map to apply a Marijuana
<br />5 Cultivation Candidate Sites (MCCS) Overlay zone, with the underlying zone to remain unchanged,
<br />6 for certain parcels.
<br />7 WHEREAS, the Planning Commission of the City of Colton ("Planning Commission")
<br />held a public hearing on October 24, 2017, after giving published notice to consider a
<br />8 recommendation to the City Council of a Code Text Amendment amending chapters 18.06.160,
<br />and 18.48.130 and adding a new chapter 18.48.134 establishing permitting procedures for
<br />9 commercial marijuana cultivation and other commercial marijuana activities and a Zoning Map
<br />10 Amendment for a change of zone to apply a marijuana cultivation candidate sites ("MCCS")
<br />overlay zone for the following areas:

<br />1. Area A. Parcels zoned I -P, Industrial Park, within an area bounded by the 1-10 Freeway
<br />12 to the south, Santa Ana River to the east, San Bernardino City Limits to the north, and
<br />the flood control wash (Warm Creek) to the west, including parcels along Fairway
<br />13 Drive, Crossway Drive, and Auto Center Drive, including those identified with the
<br />14 following Assessor Parcel Numbers (APN):
<br />• APN 0164-182-35, -36, -38, -39, -41, -43, -46, -47, -48, -51, -53, -55, -57, &-
<br />15 58;
<br />• APN 0164-201-11; 0164-202-09,-35,-46, -49,-50, & -51; and
<br />16 • APN 0164-281-01, -02, -09, &-11.
<br />17 2. Area B-1. Parcels zoned M-1, Light Industrial within an area bounded by the 1-10
<br />18 Freeway to the north, Union Pacific Railroad to the south, San Bernardino City Limits
<br />to the east, and Santa Ana River to the west, including parcels along Steel Road, Hunts
<br />19 Lane, and Oliver Holmes Road including those identified with the following Assessor
<br />Parcel Numbers (APN):
