2 <br />0 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-12-16 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON <br />TO AMEND TITLE 18, CHAPTER 18.06 (PERMITTED USES), 18.23 <br />(MIXED-USE DOWNTOWN), AND ADD NEW SECTION 18.23.04 <br />(GENERAL COMMERCIAL DOWNTOWN OVERLAY) AND TO <br />CHANGE THE ZONE TO CERTAIN PROPERTIES FROM C-2 <br />(GENERAL COMMERCIAL) TO M-U/D (MIXED USE DOWNTOWN) <br />AND C-2 (GENERAL COMMERCIAL) TO C-2/1) (GENERAL <br />COMMERCIAL) ZONE TO ENSURE CONSISTENCY WITH ADOPTED <br />GENERAL PLAN AND STATE LAW (FILE INDEX NO. DAP -001-307). <br />WHEREAS, on June 28, 2016, the Planning Commission of the City of Colton ("Planning <br />Commission") conducted a duly noticed public hearing and recommended the City Council of the <br />City of Colton ("City Council") amend Section 18.06 (Permitted Uses), and 18.23 (Mixed -Use <br />Downtown), and add new Section 18.23.04 (General Plan Downtown Overlay) Zone of Title 18 of <br />the Colton Municipal Code (the "Municipal Code"). Following the conclusion of said hearing, the <br />Planning Commission adopted their Resolution No. R-19-16, recommending approval to the City <br />Council ("Zoning Text and Map Amendments"); and <br />WHEREAS, the Planning Commission adopted a Resolution recommending approval of <br />the Zoning Text Amendment to the City Council; and <br />WHEREAS, the City Council has determined that the Zoning Text Amendment is <br />consistent with the City of Colton General Plan ("General Plan") as indicated below; and <br />WHEREAS, the City Council has determined that the proposed Zoning Text Amendment <br />is in the best interests of the City, and that it would be in the public interest to approve the Zone <br />Text Amendment; and <br />WHEREAS, the Zoning Map and Text Amendments were reviewed, studied and pursuant <br />to the California Environmental Quality Act ("CEQA"), an Initial Study was prepared of the <br />potential environmental effects of the project. Based on the findings contained in that Initial Study, <br />City staff determined that there would be no substantial evidence that the project would have a <br />significant effect on the environment. Based on that determination, a Negative Declaration was <br />prepared. Thereafter, the City staff provided public notice of the public comment period and of the <br />intent to adopt the Negative Declaration; and <br />WHEREAS, on July 19, 2016, the City Council held a duly noticed public hearing at which <br />persons wishing to testify in connection with the Zoning Text and Map Amendments were heard <br />and the Zoning Text and Map Amendments was comprehensively reviewed; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. The City Council hereby adopts the recitals and findings set forth above and <br />in the agenda report prepared in connection with this Ordinance. <br />SECTION 2. General Plan Consistency. Based on the entire record before the City <br />Council and all written and oral evidence presented, including the staff report and the findings made <br />
