City Council Ordinance No. 0-12-16 <br />Page 2 of 3 <br />1 in this Ordinance, the City Council hereby finds and determines that the proposed Ordinance is <br />consistent with the goals and policies of the City of Colton General Plan and is reasonably related <br />2 to the public welfare of the citizens of the City and surrounding regions. Specifically the Mixed - <br />Use Downtown changes and the new General Commercial Downtown Overlay Zone is consistent <br />3 and furthers the City's goals and policies as set forth in the City of Colton General Plan, <br />specifically: <br />4 <br />Land Use Element. in addressing new mixed-use, walkable neighborhoods in downtown <br />5 policies of the City of Colton Land Use Element, specifically: <br />6 Goal LU -10: "Create new mixed-use, walkable districts that are great places to live and exciting <br />7 destinations." The proposed Ordinance text and map amendments provide for creating a vibrant <br />and distinctive character within the outlined boundaries of the downtown. The proposed code <br />8 amendments provide for more defined setbacks and parking within the downtown Colton area and <br />provides a link to the proposed Downtown Design Manual in setting design criteria for making <br />9 mixed-use, walkable downtown neighborhoods. <br />10 Policy LU -10.2: "Adopt a new Neighborhood Mixed -Use zone." The proposed General <br />11 Commercial Overlay Zone further enhances and balances the Downtown area along Valley <br />Boulevard generally between Pennsylvania Avenue and Mt. Vernon Avenue. <br />12 <br />Policy LU -10.4: "Establish land use patterns and provide pedestrian amenities within the <br />13 mixed use districts that minimize the need for vehicle travel among the uses within a <br />district." The proposed text and zoning map amendments further support this policy along with <br />14 its companion document, Downtown Design Manual, in establishing land use patterns with <br />15 pedestrian amenities within the Colton Downtown area. <br />16 Finally, the City of Colton finds that the attached Zone Text and Map Amendment to permit <br />appropriate uses within the mixed-use zoned properties is reasonably related to the public welfare <br />17 of the citizens of the City and surrounding region; more specifically, Chapters 18.06 (Permitted <br />Uses), 18.23 (Mixed -Use Downtown), and add new section 18.23.04 (General Commercial <br />18 Downtown Overlay) and to change the zone to certain properties from C-2 (General Commercial) <br />to M-U/D (Mixed Use Downtown) and C-2 (General Commercial) to C-2/1) (General Commercial) <br />19 Zone in the Colton Municipal Code. The Ordinance includes appropriate restrictions to ensure that <br />the permitted encroachments and parking are integrated into the overall community pattern of M- <br />20 U Downtown and General Commercial Mixed Use Overlay zones for revitalization of Colton's <br />Downtown. (File Index No. DAP -001-307). <br />21 <br />SECTION 3. The City hereby adopts the Zoning Map Amendment in Exhibit "B" and <br />22 Zoning Text Amendments in Exhibit "C" to be consistent with the City's General Plan. The <br />proposed Zoning Map and Zoning Text Amendments area a continued part of the implementation <br />23 consistency program of the General Plan Update deleting, renaming and adding new zoning <br />24 districts and categories in the City of Colton, County of San Bernardino. <br />25 SECTION 4. If any sentence, clause or phrase of this Ordinance is for any reason held to <br />be unconstitutional or otherwise invalid, such decisions shall not affect the validity of the remaining <br />26 provisions of this Ordinance. <br />27 SECTION 5. The City Council hereby finds and determines that it can be seen with <br />certainty that there is no possibility that this Ordinance may have a significant adverse effect on the <br />28 environment.
