1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the City's Solicitors — Canvassers regulations, Chapter 5.16 of Title 5 of <br />the Colton Municipal Code, was adopted in 1950 with minor amendments adopted in 1972; <br />and <br />WHEREAS, it has been determined that the Solicitors — Canvassers regulations are <br />out of date with respect to current legal interpretations and standard practices; and <br />WHEREAS, the City Council now wishes to amend Chapter 5.16 to bring the <br />Solicitors — Canvassers regulations into conformity with current legal interpretations and <br />standard practices; <br />WHEREAS, Chapter 5.24 of the Colton Municipal Code presently provides a system <br />through which massage parlors and massage technicians are regulated by the City; and <br />WHEREAS, in 2008, the Legislature adopted Senate Bill 731, which created the <br />California Massage Therapy Council, a state -organized nonprofit organization with regulatory <br />authority over the certification of massage practitioners throughout the State of California; <br />and <br />WHEREAS, Senate Bill 731 has been widely criticized by local agencies as providing <br />massage businesses with almost unprecedented protection from local zoning and land use <br />authority, and interfering with local law enforcement efforts to close massage businesses that <br />allow prostitution, human trafficking and other illegal activities; and <br />WHEREAS, Assembly Bill 1147, signed by Governor Jerry Brown, was created in <br />response to criticism against Senate Bill 731 and allows local agencies to impose reasonable <br />zoning, business licensing, and health and safety requirements on massage establishments; <br />and <br />-2- <br />
