The costs for installation, maintenance, and replacement of the Property Owner <br />6 Sewer Service Lateral (Upper Portion) as defined in Section 13.08.105, $shall be the responsibility <br />7 of the Property Owner. <br />8 B. The costsfor installation, maintenance, and replacement ofthe City Sewer Service <br />9 Lateral (Lower Portion) as defined in Section 13.08.105, shall be the responsibility of the City." <br />10 SECTION 3: Section 13.08.204 of Chapter 13.08 of Title 13 of the Colton Municipal <br />Code is hereby amended to read as follows: <br />11 <br />"13.08.204 Responsibility for removal of Obstructions in Property Owner Sewer Service Laterals <br />12 (Upper Portion). <br />13 The City is not responsible for maintaining the Property Owner Sewer Service Lateral <br />14 (Upper Portion) as defined in Section 13.08.105. If any section, subsection, subdivision, paragraph, <br />sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to <br />19 <br />unconstitutional, such decision shall not affect the validity of the remaining portion of this ordinance <br />20 or any part thereof. The City Council of the City of Colton hereby declares that it would have passed <br />21 each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of <br />22 the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrases <br />23 be declared unconstitutional. <br />24 SECTION 6: This ordinance shall take force and effect thirty (30) after its adoption. <br />25 <br />26 <br />27 <br />28 <br />2 <br />
