2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-03-14 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON TO <br />AMEND VARIOUS PROVISIONS OF CHAPTERS 18.04, 18.14, 18.38, 18.39. 18.50 <br />AND 18.58 OF TITLE 18 OF THE COLTON MUNICIPAL CODE PERTAINING <br />TO ADMINISTRATIVE AND MINOR DISCRETIONARY PERMIT <br />APPLICATION REVIEW AND APPROVAL PROCEDURES (FILE INDEX NO. <br />DAP -001-133) <br />WHEREAS, on January 14, 2014, the Planning Commission of the City of Colton <br />("Planning Commission") conducted a duly noticed public hearing and recommended the City <br />Council of the City of Colton ("City Council") amend Chapters 18.04, 18.14, 18.38, 18.39, 18.50 <br />and 18.58 of Title 18 of the Colton Municipal Code (the "Municipal Code") to streamline <br />administrative and minor discretionary permit application review and approval purposes (Zone <br />Text Amendment); and <br />WHEREAS, the Planning Commission adopted a Resolution recommending approval of <br />the Zone Text Amendment to the City Council; and <br />WHEREAS, the City Council has determined that the Zone Text Amendment is <br />consistent with the City of Colton General Plan ("General Plan") as indicated below; and <br />WHEREAS, the City Council has determined that the proposed Zone Text Amendment is <br />in the best interest of the City, and that it would be in the public interest to approve the Zone Text <br />Amendment; and <br />WHEREAS, the Zone Text Amendment was reviewed, studied and found exempt from <br />the California Environmental Quality Act ("CEQA") as more fully described below; and <br />WHEREAS, on February 18, 2014, the City Council held a duly noticed public hearing at <br />which persons wishing to testify in connection with the Zone Text Amendment were heard and <br />the Zone Text Amendment was comprehensively reviewed; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. The City Council hereby adopts the recitals and findings set forth above <br />and in the agenda report prepared in connection with this Ordinance. <br />SECTION 2. General Plan Consistency. Based on the entire record before the City <br />Council and all written and oral evidence presented, including the staff report and the findings <br />made in this Ordinance, the City Council hereby finds and determines that the proposed Zone <br />Text Amendment is consistent with the goals and policies of the City of Colton General Plan and <br />is reasonably related to the public welfare of the citizens of the City and surrounding regions. <br />Specifically, the provisions of this Zone Text Amendment facilitate streamlined review of various <br />minor administrative and discretionary permits, furthering the City's goals and policies as set <br />forth in the City of Colton General Plan, specifically: <br />Housing Element. Streamlining of the permitting process will help reduce governmental <br />constraints to meeting the City's housing needs. This includes partial implementation of Policy <br />H-5.1 to "review and adjust as appropriate residential development standards, regulations, <br />ordinances, department processing procedures, and residential fees related to rehabilitation and <br />
