RESOLUTION NO. R-106-88 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON ESTABLISHING STORM DRAIN FACILITIES <br />FEES FOR DRAINAGE BENEFIT AREA NO. 1 <br />WHEREAS, the City Council of the City of Colton ("this <br />City Council") has adopted Ordinance No. 0-27-88 to establish the <br />requirement for the payment of storm drain fees by new subdivision <br />development within Drainage Benefit Area No. 1 to ensure that <br />storm drain facilities and improvements are constructed and made <br />available concurrent with the need caused by such new development; <br />and <br />WHEREAS, Ordinance No. 0-27-88 requires that this City <br />Council shall, by resolution, set the specific amount of fees <br />which will be levied upon new subdivision development within <br />Drainage Benefit Area No. 1; and <br />WHEREAS, the City's Public Works Director has undertaken <br />a comprehensive study of the storm drain facilities needed to <br />serve new subdivision development proposed within Drainage Benefit <br />Area No. 1; and <br />WHEREAS, the results of the Public Works Director's <br />study demonstrate that the storm drain facilities fees should be <br />based upon the gross number of acres proposed within each new <br />subdivision development and the estimated runoff calculation <br />resulting from the construction of such development; and <br />WHEREAS, this City Council has further adopted an <br />urgency ordinance as an interim measure to cause the storm drain <br />fees for Drainage Benefit Area No. 1 to take effect immediately. <br />
