R-121-96 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON REQUESTING RELIEF FROM SAN <br />BERNARDINO COUNTY ASSESSMENT DISTRICT FOR <br />THE SAN TIMOTEO FLOOD CONTROL PROJECT <br />WHEREAS, on March 19, 1996, the City Council of the City of Colton adopted <br />Resolution R-25-96 which determined that property within the City would benefit from <br />improvements to be constructed for storm water drainage purposes in the San Timoteo Creek <br />area (the "San Timoteo Creek Flood Control Project") which is a part of the Santa Ana River <br />Main Stem Project, which is a regional flood control project approved by the United States <br />Congress and funded in substantial part by the federal government; and <br />WHEREAS, subsequent adoption of Resolution R-25-96, it has come to the attention of <br />the City that in all other projects included within the Santa Ana Main Stem Project, including <br />the Seven Oaks Dam, the Mill Creek Levy and improvements to Prado Dam near Corona, all <br />of which are projects of regional value and multi jurisdictional impact, the local share of cost <br />for such projects has been paid within San Bernardino County by the County's Flood Control <br />District (the "District") through the use of available cash, services and contributions of District <br />land, spreading the cost of these improvements throughout the County; and <br />WHEREAS, only with regard to the San Timoteo Creek Flood Control Project does it <br />appear that local communities and residents have been required to pay the cost of the project <br />through local property assessments; and <br />WHEREAS, in view of the longstanding policy of the County of San Bernardino to fund <br />projects included within the Santa Ana River Main Stem Project through the County's Flood <br />Control District rather than by assessments on landowners it is unfair to burden landowners <br />
