DAP-001-453) <br />WHEREAS, on June 11, 2024, the Planning Commission of the City of Colton ("Planning <br />Commission") conducted a duly noticed public hearing and recommended that the City Council <br />adopt a Change of Zone, Case No. DAP-001-453, to amend the City Zoning Map from C-2 <br />(General Commercial to M-U/D (Mixed Use Downtown) at 645 South 7ch Street (APN: 0163-172- <br />48); and <br />WHEREAS, on October 1 and 15, 2024, the City Council of the City of Colton ("City <br />Council") conducted a duly noticed public hearing and adopts Zone Change No. DAP-001-453 <br />changing parcels 0163-172-48 from C-2 (General Commercial) to M-U/D (Mixed -Use Downtown) <br />of title 18 of the Colton Municipal Code (the "Municipal Code"); and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. The City Council hereby adopts the recitals and findings set forth and in the <br />agenda report prepared in connection with this Ordinance. <br />a. That the proposed change ofzone is in conformity with the General Plan of the City; <br />the existing General Plan Land Use Element is also proposed to be amended with <br />regard to the subject area from General Commercial to Mixed -Use Downtown. <br />Therefore, the proposed zone change will be in conformity with the Colton General <br />Plan and recently approved South Colton Livable Corridor Plan. <br />b. That there is a need in the community for more of the types of uses permitted by the <br />zone; the proposed zone will provide an opportunity for an residential development, <br />specifically a converted warehouse use to residential use that will serve a need in <br />the community and will provide additional housing for the City. <br />C. That the proposed change of zone would not adversely affect the surrounding area <br />or the community in general; the proposed zone change area is currently surrounded <br />by residential and commercial land use designations. The proposed change in land <br />use would not adversely affect the surrounding area in that the proposed mixed -use <br />use will be compatible and consistent with the existing surrounding uses. <br />SECTION 2. General Plan Consistency. Based on the entire record before the City <br />Council hereby recommends approval and adopts the Zone Change and the General Plan <br />Amendment No. DAP-001-453, in substantially the form attached hereto as Exhibit "A." and adopt <br />Final Environmental Impact Report and Mitigation Monitoring Report approved in City Council <br />Resolution R-93-24. <br />
