JOHNSON, PERSONNEL DIRECTOR �J <br />DATE: 10-1-91 <br />SUBJECT: PROPOSED AMENDMENT TO MANAGEMENT/CONFIDENTIAL UNIT MOU <br />BACKGROUND: <br />Article XXII of the Management/Confidential Unit MOU grants each Fire <br />Division Chief a standby allowance of $255.00 per month. The article <br />states that "this payment shall be considered wages for purposes of <br />PERS contributions." <br />Section 20022 of the California Government Code defines <br />"compensation" for PERS purposes. Subsection (b) (10) states that <br />compensation shall not include "special compensation for additional <br />services outside regular duties, such as standby pay, callback pay, <br />court duty, allowance for automobile, bonuses for duties performed <br />after regular work shift." <br />At the direction of the City Manager, the Finance Director and I met <br />with Dena Smith of SBPEA and agreed to substitute the following <br />paragraph for the current language in Article XXII of the <br />Management/Confidential MOU: <br />"Each Fire Division Chief will be required to work scheduled <br />standby and call -out time as assigned by the Fire Chief. The <br />salary for the classification includes compensation for such <br />standby and call -out time." <br />Exhibit "A" of the MOU would be amended to list range #22 for Fire <br />Division Chief. This is an existing range where "C" step is $256.00 <br />above "C" step of range 121, the current range for Fire Division <br />Chief. <br />RECOMMENDATION <br />Staff recommends that Council authorize the <br />attached side letter implementing the above <br />Concur Ar!�) <br />City Manage <br />City Manager to sign the <br />MOU language change. <br />q <br />
