j <br />LAW OFFICES OF f - <br />BEST, BEST & KRIEGEk <br />MEMORANDUM <br />June 7, 1993 <br />TO: MAYOR, CITY COUNCIL, CITY MANAGER <br />FROM: CITY ATTORNEY <br />RE: CITY COUNCIL APPROVAL OF THE EMPLOYMENT OF <br />DEPARTMENT HEADS <br />The City Council recently directed us to prepare appropriate legislation that <br />would make it clear that department heads in the City of Colton are to be employed by and <br />serve at the pleasure of the City. Under the Colton Municipal Code as presently drafted, <br />responsibility for employment of department heads rests exclusively with the City Manager. <br />We have drafted for your review the attached amendment to the Colton <br />Municipal Code that limits the granting of authority to the City Manager regarding <br />employment of 'department heads. The new language underscores the role of the City <br />Council as the final ratifying body for department head employment decisions made by the <br />City Manager. The amendment also codifies the formal duty of the City Manager to confer <br />with the City Council regarding the performance and employment of department _heads <br />including possible termination, and to hear and consider any concerns that might be <br />expressed by the City Council in carrying out his duty in this regard. <br />In the course of our preparation of the ordinance revision, we discovered that <br />the current ordinance establishing the duties and responsibilities of the City Manager, was <br />adopted by a vote of the people of the City of Colton in 1956.
