CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF JUNEj1; 1996 <br />TO: Honorable Mayor and City Council <br />APPROVAL: Nabar nr ue Marti& -Manager jFROM: a amora�Community Develop <br />SUBJECT: Appeal to the City Council regarding the Planning Commission's <br />Decision to Deny File Index Number DZGT-12-96/Tentative <br />Tract # 15610 <br />DATE: May 30, 1996 <br />BACKGROUND: <br />On April 23, 1996, the Planning Commission denied Filed Index Number DZGT-12- <br />96/Tentative Tract #15610, a request from the City of Colton Redevelopment Agency <br />for an Architectural and Site Plan Review, Environmental Assessment, Tentative Tract <br />#15610 Review, General Plan Amendment, and Zone Change for the construction of 36 <br />single family residential units on 12 vacant parcels of property bounded by "G", "H", <br />10th and proposed 11th Streets. <br />In order for the proposed project to proceed, the Agency was requesting a General <br />Plan Amendment from Office/Business Park to Planned Community Development, and <br />a Zone Change from BP (Business Park) to R-1/PC (Single Family Residential/Planned <br />Community). After receiving public testimony, the Commission denied the request. <br />Attached are the Official Minutes of the Planning Commission Meeting of April 23, 1996 <br />(Attachment A). <br />Pursuant to Section 16.28.070, Tentative Map - Appeal of City Action, "The action of <br />the advisory agency taken on a tentative map in ... disapproving said map may be <br />appealed to the City Council...," and Chapter 16.36, APPEALS, Section 16.36.010, <br />Filing - When - Contents, "Appeals shall be filed with the City Clerk within fifteen days <br />after the action of the advisory agency from which the appeal is being taken." On May <br />2, 1996, nine days after the Planning Commission denial of the proposed project, an <br />appeal was filed with the City Clerk, by Councilmembers Abe Beltran and Donald <br />Sanders.
