VEGA, FINANCE DIRECTOR 0 <br />SUBJECT: APPROVE RESOLUTION REGARDING AUDITS OF GAS, ELECTRIC, WATER, TELEPHONE, WASTE <br />MANAGMENT AND CAN UTILITY USERS TAXES AN FRANCISE FEES <br />DATE: AUGUST 27, 1996 <br />BACKGROUND <br />The City Council executed a contract with Municipal Resource Consultants (MRC) to conduct sales tax, utility users tax <br />and franchise fee audits. <br />DISCUSSION/ANALYSIS <br />fes. MRC is on the process of conducting such audits. However, MRC is recommending that the attached resolution be <br />approved authorizing the Mayor to sign subpoenas' pursuant to Government Code Section 37104 et seq. These <br />subpoenas are necessary in order to obtain information for the audits. (Attached are copies of such subpoenas.) MRC <br />also stated that in their experience, the electric and gas companies require such subpoenas prior to commencement of <br />audits. <br />ALTERNATIVES None <br />FINANCIAL IMPACT None <br />RECOMMENDATION <br />Staff recommends that the City Council approve the attached resolution authorizing the Mayor to issue subpoenas for <br />purposes of conducting an audit of the City's gas, electric, water, telephone, waste management and CAN utility users <br />tax and franchise fees. <br />f <br />ATTACHMENTS: RESOLUTION/SUBPONEAS ITEM NO. 27 <br />
