AGENDA REPORT <br />CITY OF COLTON <br />For City Council Meeting of <br />September 17, 1996 <br />September 10, 1996 <br />TO: MAYOR FULP, CITY COUNCIL AND ITY MANAGER <br />I <br />FROM: Julie Hayward Biggs, City Att ey <br />SUBJECT: Term Limits Ordinance/Resolution <br />As you requested, I have prepared the attached draft Resolution and Ordinance <br />establishing term limits for the members of the City Council and the Mayor as permitted under <br />the provisions of California Government Code Section 36502(b). That statutory provision only <br />relates to the Mayor and other members of the City Council and has no bearing on other elected <br />officers within the City. <br />Section 36502(b) allows the City Council to place this proposal on the ballot at <br />the next regular election within the City. The County Registrar of Voters has confirmed that <br />r*N the date of the next regular election that is currently scheduled within the County and in which <br />citizens of Colton will participate is the school board election which will be held on November <br />4, 1997. Section 36502(b) requires that this matter be placed on a re ular election, so it is not <br />possible for the City Council to call a special election for the purpose of voting on this proposed <br />measure. Should another regular election be called County -wide in March, April or June of <br />1997, this matter could be placed on that ballot. <br />eo"" <br />As written, the ordinance would limit the Mayor and City Councilmembers to <br />eight consecutive years in office. After serving for eight consecutive years in office, a hiatus <br />of at least four years is required before an individual is again eligible to run for the same <br />position previously held. Councilmembers who have served eight years in office may, <br />however, run for the office of Mayor, and would be eligible to serve an additional eight <br />consecutive years in that office. Similarly, a Mayor having served eight consecutive years in <br />office is eligible to serve an additional eight consecutive years as a district Councilmember. <br />Because this matter was not on the previous agenda for discussion, the limitations <br />that appear in this draft ordinance are somewhat arbitrary. I would recommend that the Council <br />consider the draft ordinance and after public discussion direct this office to make any appropriate <br />changes before submitting the matter to the electorate. <br />Concurrence: <br />Malik Dantala Freeman, City Manager <br />ITEM NO_ 37 <br />
