CITY OF COLTON <br />AGENDA REPORT <br />FOR THE COUNCIL MEETING OF MARCH 17,1998 <br />TO: MAYOR AND CITY COUNCIL <br />FROM: CAROLINA P. BARRERA <br />City Clerk <br />SUBJECT: CONFLICT OF INTEREST CODE - AMENDMENT <br />DATE: March 5, 1998 <br />BACKGROUND: <br />In 1976 and 1977, the City Council established the City's Conflict of Interest Code in compliance with <br />the Political Reform Act of 1974. In 1988, it augmented "the Code" by incorporating the State's <br />Standard Model Conflict of Interest Code. Through the years, the City has amended the Conflict of <br />Interest Code, specifically the "Designated Employee" identified in Government Code Section 82019: <br />" `Designated employee' means any officer, employee, member, or consultant of any <br />agency whose position with the agency; <br />"(c) is designated in a Conflict of Interest Code because the position entails the making <br />or participation in the making of decisions which may foreseeably have a material effect on <br />any financial interest; <br />" `Designated employee' does not include an elected state officer, any unsalaried <br />member of any board of commission which serves a solely advisory function, any public <br />official specified in Section 87200..." <br />The term "designated employee" does not include public officials specified in Government Code <br />Section 87200, namely, mayors, city councilmembers, city managers, city attorneys, city treasurers, <br />planning commissioners and other city and county officials who manage public investments. <br />ANALYSIS/DISCUS SION: <br />As the official filing officer, the City Clerk's Office has, as one of its responsibilities, the tracking of <br />who is required to file the Statement of Economic Interest Forms (Form 700) - upon the person's <br />assuming or leaving a position or office. With numerous changes in commission appointments and <br />employee positions, it became necessary to review the "designated" positions list, preliminary to the <br />annual distribution of the form. <br />RECOMMENDATION: <br />Staff recommends that City Council approve and adopt the proposed Resolution amending Appendix <br />"A" pertaining to designated positions, including board and commissions. <br />Attachments: Memorandum dated February 4, 1998 and Resolution with Appendices "A" and `B" <br />Report prepared by T.
