AGENDA REPORT <br />For Council Meeting of April 6, 1999 <br />TO: Honorable Mayor and Council <br />FROM: City Attorney( <br />SUBJECT: Rocks Club Dance Permit Application <br />1999 <br />Background: <br />On December 8, 1998, the Planning Commission approved the Design Review Committee's <br />recommendation to approve Olympia Gill & Lounge, Inc.'s request for modification to its conditional <br />use permit. The staff report for this item indicated that the modification to the CUP was for the <br />purpose of changing the existing family restaurant use to a sports lounge and night club. The staff <br />report further indicated that the Design Review Committee considered the applicant's proposal and <br />voted unanimously to support the proposal. <br />Several weeks after the Planning Commission's initial approval it carne to staffs attention that the <br />applicant was altering the sign on the subject premises to reflect that the new operations would be <br />conducted under the title of the "Rocks Club." Staff was concerned that what appeared to be the <br />intended use of the property was not clearly identified and, therefore, not fully reviewed during the <br />CUP modification process. Given the circumstances and the potential that the proposed use was not <br />completely understood and reviewed, staff asked the Planning Commission to review the matter and <br />give staff further direction. <br />At its meeting on February 9, 1999 the Planning Commission directed staff to review and negotiate <br />with the applicant with respect to the following items: <br />1. Parking capacity. <br />2. Security issues. <br />3. Fiscal impacts agreement. <br />4. Occupancy limits. <br />5. Design review and building permits. <br />The applicant addressed each of these issues and signed a letter agreement confirming its obligations <br />to satisfy certain conditions designed to address the above concerns. <br />The applicant then applied for a dance permit under the City's Municipal Code. The city council <br />continued review of the application for a dance permit at its last two meetings.
