AGENDA REPORT For Council Meeting of April 6, 1999 TO: Honorable Mayor and Council FROM: City Attorney( SUBJECT: Rocks Club Dance Permit Application 1999 Background: On December 8, 1998, the Planning Commission approved the Design Review Committee's recommendation to approve Olympia Gill & Lounge, Inc.'s request for modification to its conditional use permit. The staff report for this item indicated that the modification to the CUP was for the purpose of changing the existing family restaurant use to a sports lounge and night club. The staff report further indicated that the Design Review Committee considered the applicant's proposal and voted unanimously to support the proposal. Several weeks after the Planning Commission's initial approval it carne to staffs attention that the applicant was altering the sign on the subject premises to reflect that the new operations would be conducted under the title of the "Rocks Club." Staff was concerned that what appeared to be the intended use of the property was not clearly identified and, therefore, not fully reviewed during the CUP modification process. Given the circumstances and the potential that the proposed use was not completely understood and reviewed, staff asked the Planning Commission to review the matter and give staff further direction. At its meeting on February 9, 1999 the Planning Commission directed staff to review and negotiate with the applicant with respect to the following items: 1. Parking capacity. 2. Security issues. 3. Fiscal impacts agreement. 4. Occupancy limits. 5. Design review and building permits. The applicant addressed each of these issues and signed a letter agreement confirming its obligations to satisfy certain conditions designed to address the above concerns. The applicant then applied for a dance permit under the City's Municipal Code. The city council continued review of the application for a dance permit at its last two meetings.
