Parrish, Assistant City Manager <br />SUBJECT: <br />Consider: Waive Full Reading and Pass First Reading of an <br />Ordinance Adding Chapter 6.18 to the Colton Municipal Code <br />Regulating Shopping Carts and Laundry Carts, <br />ORDINANCE NO. 0-04-99 <br />DATE: <br />March 9, 1999 <br />BACKGROUND: <br />Recently the City Council directed staff to bring forward an ordinance for consideration <br />to combat the accumulation and storage of abandoned shopping and laundry carts <br />throughout the City of Colton. Attached is the document drafted by the City Attorney <br />and staff that creates the authority for us to effectively mitigate the blight created <br />throughout the community when shopping carts and laundry carts are removed form <br />their proper places and abandoned. <br />DISCUSSION/ANALYSIS <br />The ordinance under consideration declares that the unauthorized use, accumulation <br />and storage of abandoned shopping carts and laundry carts on any parcel of land <br />within the City constitutes a public nuisance. The ordinance will create a vehicle for <br />City staff to collect and store abandoned shopping carts and laundry carts from public <br />and private property (with the consent of the owner, or by warrant) providing that proper <br />notification is given. The ordinance also provides the opportunity for the city to assess <br />a redemption and storage fee to cover all costs of removal, storage and related <br />administrative procedures if such abandoned carts are not collected by the owner <br />within a specified amount of time. The redemption fee shall be established by City <br />Council Resolution and may be adjusted from time to time. Staff suggests the <br />redemption fee initially be set at $50.00 and will bring forward a resolution to that effect. <br />Persons found to be in violation of Ordinance Sections 6.18.050 (removal, possession <br />and/or alteration of carts) shall be guilty of an infraction and will be subject to fines. <br />Highlights of the proposed Ordinance are as follows: <br />❑ Upon adoption of this Ordinance it will be unlawful to remove any cart from a <br />parking facility without the prior written consent of the owner of such cart. It will also <br />be unlawful to possess any cart that has been removed from a parking facility <br />without the written consent of the owner of such cart. <br />
