CITY OF COLTON AGENDA REPORT For the City Council Meeting of October 5, 1999 TO: HONORABLE MAYOR AND CITY COUN IL APPROVAL: HENRY T. GARCIA, CITY MANAGER FROM: THOMAS K. CLARKE, UTILITY DIRECTOR SUBJECT: ADOPTION OF A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON REQUESTING THAT THE UNITED STATES CONGRESS TAKE ACTION IN AMENDING THE ENDANGERED SPECIES ACT TO DELIST THE DELHI SANDS FLOWER -LOVING FLY DATE: September 23, 1999 BACKGROUND For close to three years, the City of Colton has been dealing with the U.S. Fish and Wildlife Service in an attempt to bring about a mitigation plan which would allow for the development of property within the City that is impacted by the existence of the Delhi Sands Flower -loving Fly, an endangered species under the protection of the Endangered Species Act, DISCUSSION/ANALYSIS The existence of the Fly in Colton has slowed, and in some cases, halted the development of the West Side of Colton. This absence of aggressive development during a time of economic boom within the Inland Empire region has resulted in financial harm to the City of Colton and its residents. Numerous efforts have been made by City staff and various consultants to effectuate a compromise that would allow the City to grow and at the same time provide for the long-term recovery of the Fly. To date, no compromise has been struck. This failure can only be attributed to the unyielding demands for land and endowment funds on the part of the Service. At the September 7, 1999, meeting of the Colton City Council, direction was given to draft resolutions admonishing the Service for their failure to bring closure to this matter, and to urge the U.S. Congress to undertake a modification to act to delist the Fly. FINANCIAL IMPACT None. RECOMMENDATION That the City Council adopts the attached resolution reflecting the City's concerns regarding the Delhi Sands Flower -loving Fly, and requesting that the United States Congress take action in amending the Endangered Species Act to delist the Fly.
