Item #2 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF August 6. 2002 <br />TO: <br />Honorable Mayor and City Council <br />APPROVAL: <br />Daryl Parrish, City ManagerG04 <br />FROM: <br />City Attorney <br />SUBJECT: <br />Sound Vehicle Ordinance <br />DATE: <br />July 30, 2002 <br />BACKGROUND: <br />In light of the proposed changes to the City's Special Events permit procedures <br />contained in Chapter 5.44, the permit requirements for parades and sound vehicles that <br />are contained in Chapter 10.16 must also be amended to resolve conflicting provisions. <br />DISCUSSION/ANALYSIS: <br />Currently, Chapter 10.16 titled "Sound Vehicles - Parades" requires a permit to conduct <br />a parade, procession or caravan or to operate any sound vehicle upon a public street. <br />This Ordinance would: <br />• Repeal those provisions requiring a permit for a parade, procession or caravan <br />since Chapter 5.44, as amended, will provide the permit procedures necessary <br />for conducting such events. <br />• Not require a permit to operate a sound vehicle on public streets. This <br />Ordinance, however, would provide regulations regarding the use of such <br />vehicles on public street and any violations of such regulations would constitute a <br />misdemeanor. Violators will also be subject to administrative penalties and fines. <br />Amend those provisions regarding prohibitions on the use of sound vehicles on <br />public streets. Currently, Chapter 10.16 provides that sound vehicles may be <br />used so long as they: <br />(1) Do not come within 300 feet of any hospital or school at any time; <br />(2) Are not used between the hours of 6:30 p.m. and 9:00 a.m.; <br />(3) Are not used on any Sunday; or <br />RVPUB\AYC\636976 1 <br />
