Item #10 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF JULY 2,2002 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHER, P.E., CITY ENGINEER C <br />SUBJECT: APPROVAL OF DISADVANTAGED BUSINESS PROGRAM FOR <br />OCTOBER 1, 2001 TO SEPTEMBER 30, 2002, RESOLUTION AND <br />CERTIFICATION <br />DATE: JUNE 20, 2002 <br />BACKGROUND: <br />In 1984, City Council first adopted the Disadvantaged Business Enterprise (DBE) Program as <br />required by Federal Regulations. The program defines disadvantage businesses and goals for a <br />percentage of public works contracts to be awarded each year. Caltrans has been entrusted with <br />local agency oversight responsibility for DBE implementation since 1999, and as such, has the <br />responsibility of overseeing Colton's DBE Program. <br />New Federal Regulations (49 CFR Part 26) governing the DBE Program became effective March 4, <br />1999. Part 26 replaced Part 23, Title 49 of the California Federal Regulations (CFR), as the final <br />rule binding on all recipients of Department of Transportation (DOT) funded or assisted contracts. <br />In July 2000, Caltrans received approval from the Federal Highway Administration (FHWA) of the <br />local assistance procedures needed to implement the new regulations. Previous DBE requirements <br />(49 CFR 23) are now superseded by the new regulations (49 CFR 26). <br />In order for the City to continue to receive Federal funding for projects, such as Community <br />Development Block Grant (CDBG) projects and various other Federal -aid projects, the DBE Goals <br />Program must be reviewed and revised each Federal Fiscal Year. <br />ANALYSIS/DISCUSSION: <br />The City of Colton routinely solicits public bids for CIP Projects throughout the year; a good <br />percentage of these projects are federally funded, such as the Community Development Block <br />Grant (CDBG) Projects and the Economic Development Administration (EDA) Project recently <br />approved by Council. <br />The implementation of the DBE Program ensures nondiscrimination in the award and <br />
