FIRST AMENDMENT TO MAINTENANCE AND ABATEMENT AGREEMENT <br />BETWEEN CITY OF COLTON AND BOBBY W. STARK AND KATHIE L. STARK <br />HUSBAND AND WIFE AS JOINT TENANTS OF <br />2081 Placentia Lane(3779 W. Placentia Lane) <br />1. PARTIES AND DATE. <br />This FIRST AMENDMENT TO MAINTENANCE AND ABATEMENT AGREEMENT <br />BETWEEN CITY OF COLTON AND BOBBY W. STARK AND KATHIE L. STARK HUSBAND <br />AND WIFE AS JOINT TENANTS of 2081 Placentia Lane (3779 W. Placentia Lane) is entered into <br />this 156' day of July, 2003, between the City of Colton, a municipal corporation duly organized under <br />the laws of the State of California (`City"), and Bobby W. Stark and Kathie L. Stark ("Owners") <br />husband and wife, as joint tenants of the real property located at 2081 Placentia Lane (3 779 W. <br />Placentia Lane) in the City of Colton, County of San Bernardino, State of California (APN Nos.: 277- <br />022-44 & 277-022-45) (`Subject Property"). <br />2. RECITALS. <br />2.1 Whereas City and Owners entered into a Maintenance and Abatement Agreement <br />concerning the Subject Property on June 18, 2002 (the "Agreement"); <br />2.2 Whereas pursuant to the Agreement Owners agreed to take certain actions to abate <br />certain conditions on the Subject Property within one year from June 18, 2002; <br />2.3 Whereas Owners have taken reasonable steps to comply with the Agreement, but have <br />requested additional time to completely abate the conditions on the Subject Property, and <br />2.4 Whereas in the interest of gaining compliance with all City codes and ordinances and <br />in order to abate the Conditions located on the Subject Property as expeditiously as possible in a <br />reasonable amount of time, without City enforcing its rights under the Agreement at this time, City <br />and Owners wish to amend the Agreement. <br />NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES AND <br />AGREEMENTS HEREIN CONTAINED, THE PARTIES HERETO AGREE AS FOLLOWS: <br />The Agreement is hereby amended, and City and Owners agree, as follows: <br />3. TERMs. <br />3.1 Section 3.3.2(c) shall be added to provide as follows: <br />"Section 3.3.2(c). The time period in Section 3.3.2 may be extended in <br />RVLITCL5\649434 <br />
