ITEM #12 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF DECEMBER 20, 2005 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: AMER JAKHER, P.E.; PW DIRECTOR/CITY ENGINEER <br />SUBJECT: APPROVE THREE RESOLUTIONS TO ANNEX TRACT 16289 AND <br />TRACT 16249 INTO LLMD2, ZONE 2: 1) RESOLUTION INITIATING <br />PROCEEDINGS, 2) PRELIMINARY APPROVAL OF THE ENGINEER'S <br />REPORT, AND 3) RESOLUTION OF INTENT. <br />DATE: DECEMBER 14, 2005 <br />BACKGROUND: <br />There exist two Landscape Lighting and Maintenance Districts (LLMD) within the City of <br />Colton. Each District is provided the services of maintaining ornamental lighting, <br />landscaping and all applicable facilities within its boundaries. Each LLMD can house <br />various zones. The levy assessed per zone is determined by the benefit units each <br />property type (residential, industrial or commercial) is assigned as compared to the 1.00 <br />Equivalent Benefit Unit (EBU) a single family resident is assigned; the single family unit is <br />used as the basic unit of assessment. In addition to the EBU, the other determining factors <br />in establishing each zone's corresponding assessment are the development status and the <br />acreage of each parcel. The costs associated with maintaining the improvements within <br />each zone are then equally distributed to those parcels within the zone. Only parcels that <br />directly benefit from the improvements are assessed. <br />DISCUSSION/ANALYSIS: <br />Both tracts 16289 and 16249 are developing homes within District 5, east of Reche Canyon <br />Road. Tract number 16289 is being developed by Wyn Holmes and will accommodate <br />ninety-two new homes. Each house sits on a half acre lot. The developer will install <br />irrigation lines and install landscaping along Reche Canyon Road and Crystal Ridge Lane. <br />This tract has a total of 92 lots and 26.60 acres of common area that will be maintain by the <br />City once incorporated into the LLMD; of the 26.60 acres 19.61 acres are non -irrigated, and <br />the remaining 6.99 acres is irrigated open -space. The irrigated areas will require <br />significantly higher maintenance levels than the non -irrigated areas. Tract number 16249 <br />will be subdivided into 49 lots, of these 47 lots will be half acre residential lots; the <br />developer for this tract is Ralph Herzing. The landscaping improvements will be <br />constructed by the developers and henceforth maintained by the City. These <br />improvements have been assessed to result in an annual cost of $385.15, per home, for <br />fiscal year 2006/2007. The attached cost analysis, Exhibit `B,' depicts the acreage and the <br />total costs of maintenance. <br />The property owners of the two tracts proposed to be annexed into Zone 2 of LLMD No. 2. <br />Under the provisions of the LLMD Act of 1972, a single property owner can request <br />annexation into a Maintenance District.
