2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Item <br />ORDINANCE NO. 0-31-04 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON APPROVING A CHANGE OF ZONE FROM C-1 <br />(NEIGHBORHOOD COMMERCIAL) TO C-2 (GENERAL <br />COMMERCIAL) FOR PROPERTY LOCATED AT 801 NORTH <br />RANCHO AVENUE IN THE CITY OF COLTON: DAP NO. 000-335 <br />WHEREAS, Rancho Colton LLC filed an application (File No. DAP -000-335) <br />requesting an amendment to the Colton Zoning Map to amend the zoning designation of certain <br />property located at 801 North Rancho Avenue (Assessor Parcel Nos. 0162-291-013, 15 & 17) <br />("Subject Site") in the City of Colton, County of San Bernardino from C-1 (Neighborhood <br />Commercial) to C-2 (General Commercial) ("Application"); and <br />WHEREAS, the Application was reviewed, studied, and found comply with the <br />California Environmental Quality Act ("CEQA") as more fully described below; <br />WHEREAS, on October 26, 2004, the Planning Commission of the City of Colton <br />("Planning Commission") conducted a duly noticed public hearing on the Application at which <br />time all persons wishing to testify in connection with the Application were heard and the <br />Application was fully studied; <br />WHEREAS, the Planning Commission adopted a Resolution recommending <br />approval of this Zone Change to the City Council; <br />WHEREAS, on December 7, 2004, the City Council of the City of Colton ("City <br />Council") conducted a duly noticed public hearing on the Application at which time all persons <br />wishing to testify in connection with the Application were heard and the Application was fully <br />examined; and <br />occurred; <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION 1. Based on the entire record before the City Council, all written and <br />oral evidence presented to the City Council, and the findings set forth in this Ordinance, the City <br />Council of the City of Colton hereby designates the Subject Site shown on the attached Exhibit <br />All as within the C-2 (General Commercial) zoning district as defined in Title 18, Chapter 18.22 <br />of the Colton Municipal Code. <br />SECTION 2. Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds the Zone Change is consistent with the <br />General Plan of the City of Colton because designation of the Subject Site within the C-2 <br />RVPUB\MXM\682852.1 - I - <br />
