ITEM #5 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF June 21, 2005 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHER, P.E., CITY ENGINEER <br />SUBJECT: APPROVE AND ADOPT ORDINANCE AMENDING CHAPTER 6.18 OF <br />THE COLTON MUNICIPAL CODE REGARDING THE REGULATION <br />OF SHOPPING CARTS AND LAUNDRY CARTS <br />DATE: June 14, 2005 <br />BACKGROUND: <br />In 1999, the City Council adopted Ordinance No. 0-06-99 (codified as Chapter 6.18 in the Colton <br />Municipal Code), which regulates abandoned shopping carts and laundry carts. The ordinance <br />defines abandoned shopping carts and laundry carts as public nuisances because they degrade <br />the appearance of the community and obstruct free access to public and private sidewalks, <br />streets and parking lots. The ordinance prevents the unauthorized removal of carts from parking <br />facilities, requires carts to have identification signs showing the owner's business information and <br />establishes a procedure for the City to abate abandoned carts. The City's existing ordinance is <br />based on authority provided in the California Business and Professions Code section 22435 et <br />seq. <br />1I61d1R1*-i W N 711Ik ��3 <br />City staff has prepared an amendment to the existing ordinance which will accomplish the <br />following goals: <br />(1) Clarify existing language in the ordinance regarding the provision which allows the City to <br />impound abandoned carts without providing a three-day advance notice to the cart owners. The <br />existing ordinance provides two methods of abatement of abandoned carts. The first method <br />involves locating abandoned carts and then giving the owners three days advance notice before <br />City staff may go back to pick up the carts. The second method of abatement in the ordinance <br />allows City staff to impound abandoned carts immediately and provide the cart owners with actual <br />notice of the abatement within 24 hours. This second method is preferred by City staff since it <br />makes better use of staff time by requiring only one trip to both locate and pick up abandoned <br />carts. City staff felt that a minor clarification to the language in the ordinance regarding this <br />provision would be helpful. The clarifying language follows the provisions in the Business and <br />Professions Code. <br />
