cia CITY OF COLTON CLOSED SESSION - COUNCIL/REDEVELOPMENT AGENCY/COLTON UTILITY AUTHORITY DECEMBER 06, 2005 In accordance with notice duly and legally given, a Regular Meeting was held on the above given date at 5:06 p.m., in the Council Chambers of City Hall, with Mayor Bennett presiding. CITY COUNCIL ROLL CALL Councilmembers present were, Mitchell, Suchil, Chastain, De La Rosa and Mayor Bennett. CM Hernandez and CM Ramos absent. City Attorney Derleth announced that the City Council would meet in Closed Session to discuss item A through C. City Attorney Derleth announced that he would recuse himself from discussion of Item C as his law firm represents US Xpress. CLOSED SESSION: A. CONFERENCE WITH LABOR NEGOTIATORS Pursuant to Government Code Section 54957.6 Agency Designated Representative: Anthony Arroyo Employee Organizations: Fire Unit, IBEW (Electric), and the Police Management Association (PMA). B. CONFERENCE WITH LABOR NEGOTIATORS Pursuant to Government Code Section 54957.6 Unrepresented Employee: City Manager Negotiating Party: Dean Derleth, City Attorney C. CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION Pursuant to Government Code Section 54956.9(a) Case Name: U.S Xpress v. the City of Colton Case Number: San Bernardino Superior Court Case No. SCVSS117350 City Attorney Derleth adjourned the meeting to Closed Session at 5:07 p.m. and at 6:00 p.m.; the meeting reconvened with all members present as heretofore. City Attorney Derleth reported that the Council did meet in Regular Closed Session and discussed Item C and would continue Item A and B to be discussed at the end of open session. C.
