1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-05-04 <br />AN ORDINANCE OF THE OF THE CITY COUNCIL OF THE CITY <br />OF COLTON AMENDING PORTIONS OF THE RECHE CANYON <br />SPECIFIC PLAN AND AMENDING THE RECHE CANYON <br />SPECIFIC PLAN LAND USE MAP SHOWN AS AN ADDENDUM TO <br />TITLE 18 OF THE COLTON MUNICIPAL CODE: FILE INDEX <br />NUMBER DT -65-01 <br />WHEREAS, Ralph Herzig filed an application in July of 2001, File No. DT -65-01 <br />(formerly DTV -65-01), for amendments to the Reche Canyon Specific Plan to accommodate <br />Tentative Tract Map No. 16249 to create a 47 -lot subdivision with 2 open space lots ("Application") <br />on a 40±- acre site located at the easterly terminus of Shadid Drive, east of Reche Canyon Road <br />(Assessor Parcel No. 0282-211-01 and more particularly described in Exhibit "A" ("Subject Site"); <br />WHEREAS, the property affected by the Application is contained within the Reche <br />Canyon Specific Plan; <br />WHEREAS, the Application was reviewed, studied, and found to comply with the <br />California Environmental Quality Act ("CEQA") as more fully described below; <br />WHEREAS, on November 27, 2001, December 10, 2002, January 14, 2003, October <br />28, 2003 (Workshop), January 6, 2004 (Field Trip) and January27, 2004, the Planning Commission <br />of the City of Colton ("Planning Commission") conducted duly noticed public hearings on the <br />Application at which time all persons wishing to testify in connection with the Application were heard <br />and the Application was comprehensively reviewed; and <br />WHEREAS, on February 17, 2004, the City Council of the City of Colton ("City <br />Council") conducted a duly noticed public hearing on the Application at which time all persons <br />wishing to testify in connection with the Application were heard, the Planning Commission's <br />recommendation was considered and the Application was comprehensively reviewed; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have <br />occurred. <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION 1. Based on the entire record before the City Council, all written and oral <br />evidence presented, and the findings made in this Ordinance, the City Council hereby approves the <br />RVPUB\MXM\666168.1 <br />
