1 <br />2 <br />3 <br />4 <br />5. <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />23 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />29 <br />30 <br />31 e <br />32 <br />RESOLUTION NO., 3625 <br />A RESOLUTION OF THE CITY OF COLTON, CALIFORNIA, <br />ORDERING, CALLING, PROVIDING FOR AND GIVING <br />NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE <br />HELD IN SAID CITY 'ON NOVEMBER 2, 1976, FOR THE <br />PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS <br />OF SAID CITY AN ORDINANCE RELATING TO AMENDING <br />THE CITY OF COLTON'S EMPLOYEESRETIREMENT PLAN <br />AND CONSOLIDATING SAID ELECTION WITH THE STATE- <br />WIDE GENERAL ELECTION TO BE HELD ON SAID DATE. <br />WHEREAS, the legislative body of the City of Colton desires to <br />submit to the qualified voters of said City, a proposed Ordinance relating to <br />amending the City of Colton's Employees Retirement Pian; and <br />WHEREAS, the City Council of the City of Colton is thereupon <br />authorized and directed by statute to submit the Ordinance to the qualified <br />voters; <br />NOW, THEREFORE, the City Council of the City of Colton, California, <br />DOES HEREBY RESOLVE,! DECLARE, DETERMINE AND ORDER as follows: <br />SECTION 1. That a special election be held and the same is hereby <br />called to be held inlsaid City on November 2, 1976, for the purpose of sub- <br />mitting to the qualified voters,of said City an Ordinance hereinafter set forth <br />relating to amending the City of�Colton's Employees Retirement Plan. <br />as follows: <br />SECTION. The proposed ordinance submitted to the voters shall be <br />Shall the City of Colton's Employees Retirement Plan, <br />originally adopted in 1945, be modified effective <br />July 1, '977; to provide improved retirement benefits <br />to Colto Police Safety Employees, herein referred to <br />as Local Safety Members, on the basis of discretionary <br />retirement at age 50, with the local safety member re- <br />ceiving a retirement of Two Percent (2%) of°their final <br />compensation for each year of service (no to exceed <br />Seventy -hive Percent (75%) of final compensation) with <br />compulsory retirement at age 60 (see California Govern- <br />ment Code Section 21252.01); to provide a widow's al- <br />lowance of One-half (1/2) of the local safety member's <br />retirement benefits on his death (see California <br />Government Code Sections 21263 and 21263.1); to pro- <br />vide retirement based on the average of one highest <br />year compensation instead of three highest years (see <br />California Government Code Section 20024.2);, and to <br />provide credit'for prior military service (see Cali- <br />fornia Government Code Section 20930.3); and the levy <br />of only such property taxes as will be necessary to <br />pay the City's 'share of said benefits, be adopted? <br />SECTION 3. That the polls for said election shall be opened at <br />seven o'clock A. M. of the day of said election and shall remain.open continu- <br />ously from said time until eight o'clock P.
