R-28-04 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON FINDING THAT THE PUBLIC INTEREST AND <br />NECESSITY REQUIRE THE SALE OF SURPLUS PROPERTY <br />LOCATED AT 1350 & 1370 AGUA MANSA ROAD (ASSESSOR <br />PARCEL NOS.. 0260-072-15 & 16) <br />WHEREAS, the City of Colton ("City') owns a surplus piece of property containing <br />approximately 6.0 acres, generally located at 1350 & 1370 Agua Mansa Road, Colton, California <br />92324; and <br />WHEREAS, California Government Code Section 37421 provides that when the <br />legislative body of a city finds that the public interest and convenience require the sale of public <br />buildings and sites dedicated to public use, it may adopt a resolution of its finding and intention to <br />sell such property; and <br />WHEREAS, the City declared its intent to sell this surplus piece of property, fix a time <br />for the hearing of any protests to the sale and fix the time for final action in a resolution adopted on <br />March 16, 2004; <br />WHEREAS, on April 6, 2004, the City Council, at a hearing duly noticed in <br />accordance with California Government Code, Section 37425, considered any protests to the City's <br />intent to sell the property and voted to proceed with the sale at such time as an offer that is <br />acceptable to the City Council is received; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />COLTON: <br />SECTION 1. The City Council of the City of Colton hereby finds that the City Council <br />has considered any written protests concerning the sale of the surplus property generally located at <br />1350 & 1370 Agua Mansa Road, Colton, California 92324 (Assessor Parcel Nos. 0260-072-15 &16), <br />more particularly described in Exhibit "A" attached hereto and made a part of this resolution. The <br />City Council hereby determines that the public convenience and necessity require the sale of the <br />surplus property at such time as an offer is received that is acceptable to the City Council.
