R-44-04 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON ADOPTING CERTAIN NEW FEES AND <br />INCREASING CERTAIN EXISTING FEES FOR VARIOUS <br />COMMUNITY AND PARK FACILITIES AND SERVICES <br />PROVIDED BY THE CITY <br />WHEREAS, under the police power granted by Article XI, Section 7 of the California <br />Constitution, cities may impose fees, charges and rates for certain municipal services; and <br />WHEREAS, in addition to the authority granted by the State Constitution, <br />Government Code section 66016 provides that a city may establish or increase fees for <br />certain public services by resolution; and <br />WHEREAS, the City Council of the City of Colton has determined that in order to <br />continue providing effective service for the public welfare, the City must establish and <br />increase fees for certain municipal services which accurately reflect the City's true costs in <br />providing such services; and <br />WHEREAS, many of the City's existing fees for community and park facilities and <br />services no longer reflect the City's true costs in providing and maintaining the services and <br />facilities to which the fees pertain, as a result of increased costs borne by the City; and <br />WHEREAS, the City Council has determined that the fees proposed in this <br />Resolution are reasonable, fair and equitable in nature and are proportionately <br />representative of the costs incurred by the City for the described services; and <br />WHEREAS, the City Council has further determined that the fees proposed in this <br />Resolution shall be implemented over a period of three years in order to ease the transition <br />for residents and non-residents in paying the proposed new and increased fees; and <br />WHEREAS, in addition, the City Council has determined that it is reasonable and <br />fair for the City to subsidize programs and facilities for residents and charge a non - <br />subsidized fee to non-residents because the subsidy is paid from municipal funds which <br />11 residents contribute to through local property taxes and sales taxes and because the <br />RVPUB\NGS\672123.1 <br />1 <br />
