1 <br />RESOLUTION NO. R-55-04 <br />2 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />3 <br />COLTON ESTABLISHING CERTAIN NEW FEES AND <br />4 INCREASING CERTAIN EXISTING FEES FOR VARIOUS <br />SERVICES PROVIDED BY THE CITY <br />5 <br />WHEREAS, under the police power granted by Article XI, Section 7 of the California <br />6 Constitution, cities may impose fees, charges and rates for certain municipal services; and <br />7 WHEREAS, in addition to the authority granted by the State Constitution, Government Code <br />8 section 66016 provides that a city may establish or increase fees for certain public services by <br />9 resolution; and <br />WHEREAS, the City Council of the City of Colton has determined that in order to continue <br />10 providing effective service for the public welfare, the City must establish and increase fees for <br />11 certain municipal services which accurately reflect the City's true costs in providing such services; <br />12 and <br />WHEREAS, the City's costs for providing services through the Geographic Information <br />13 System ("GIS") database and the Questys database have increased due to rising costs for staff and <br />14 materials required to provide the services, as well as the ongoing costs for maintaining and <br />15 upgrading the electronic databases; and <br />16 WHEREAS, although the City has heretofore borne these costs and not charged a fee for <br />these services, the City Council has determined that it is no longer cost effective for the City to <br />17 continue to bear these costs; and <br />18 WHEREAS, the City has also determined that its existing fees for duplicating audio and <br />19 video tapes of public meetings no longer reflect the City's true costs in providing these services, as a <br />result of increased costs borne by the City; and <br />20 WHEREAS, the City Council of the City of Colton has determined that in order to continue <br />21 providing effective service for the public welfare, the City must establish and increase fees for the <br />22 above described municipal services which accurately reflect the City's true costs in providing such <br />23 services; and <br />WHEREAS, the City Council has determined that the fees proposed in this Resolution are <br />24 reasonable, fair and equitable in nature and are proportionately representative of the costs incurred <br />25 by the City for the described services; and <br />26 WHEREAS, based on the information contained in this Resolution and all other information <br />presented to the City Council on this matter, the City Council desires to establish new and increased <br />27 <br />fees under the police power granted to cities by Article XI, Section 7 of the California Constitution <br />28 and pursuant to the provisions of Government Code section 66016. <br />1 <br />RVPUB\NGS\673238.1 <br />
