1 RESOLUTION NO. R-55-04 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 COLTON ESTABLISHING CERTAIN NEW FEES AND 4 INCREASING CERTAIN EXISTING FEES FOR VARIOUS SERVICES PROVIDED BY THE CITY 5 WHEREAS, under the police power granted by Article XI, Section 7 of the California 6 Constitution, cities may impose fees, charges and rates for certain municipal services; and 7 WHEREAS, in addition to the authority granted by the State Constitution, Government Code 8 section 66016 provides that a city may establish or increase fees for certain public services by 9 resolution; and WHEREAS, the City Council of the City of Colton has determined that in order to continue 10 providing effective service for the public welfare, the City must establish and increase fees for 11 certain municipal services which accurately reflect the City's true costs in providing such services; 12 and WHEREAS, the City's costs for providing services through the Geographic Information 13 System ("GIS") database and the Questys database have increased due to rising costs for staff and 14 materials required to provide the services, as well as the ongoing costs for maintaining and 15 upgrading the electronic databases; and 16 WHEREAS, although the City has heretofore borne these costs and not charged a fee for these services, the City Council has determined that it is no longer cost effective for the City to 17 continue to bear these costs; and 18 WHEREAS, the City has also determined that its existing fees for duplicating audio and 19 video tapes of public meetings no longer reflect the City's true costs in providing these services, as a result of increased costs borne by the City; and 20 WHEREAS, the City Council of the City of Colton has determined that in order to continue 21 providing effective service for the public welfare, the City must establish and increase fees for the 22 above described municipal services which accurately reflect the City's true costs in providing such 23 services; and WHEREAS, the City Council has determined that the fees proposed in this Resolution are 24 reasonable, fair and equitable in nature and are proportionately representative of the costs incurred 25 by the City for the described services; and 26 WHEREAS, based on the information contained in this Resolution and all other information presented to the City Council on this matter, the City Council desires to establish new and increased 27 fees under the police power granted to cities by Article XI, Section 7 of the California Constitution 28 and pursuant to the provisions of Government Code section 66016. 1 RVPUB\NGS\673238.1
