1 <br />2 RESOLUTION NO. R-144-05 <br />3 <br />4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON ESTABLISHING FEES REGARDING VEHICLE TOWING <br />5 AND STORAGE OF IMPOUNDED VEHICLES <br />6 <br />7 WHEREAS, underthe police powergranted by Article XI, Section 7 ofthe California <br />Constitution, cities may impose fees, charges and rates for certain municipal services; and <br />8 <br />9 WHEREAS, in addition to the authority granted by the State Constitution, <br />10 Government Code section 66016 provides that a city may establish or increase fees for <br />certain public services by resolution; and <br />11 <br />12 WHEREAS, State law specifically provides that the City may recover its costs for <br />13 towing and storage related to impoundment of vehicles and any related administrative <br />costs, pursuant to Vehicle Code sections 14602.6 and 22850.5 ; and <br />14 <br />15 WHEREAS, the City is currently in the process of developing an impound lot for the <br />16 purpose of storing towed vehicles; and <br />17 WHEREAS, the City Council has determined that the costs, including administrative <br />18 and processing costs, for towing and storing impounded vehicles at the City's impound lot <br />19 should be borne by the persons whose vehicles are impounded, rather than by the public <br />as a whole; and <br />20 <br />21 WHEREAS, the City Council has determined that in orderto provide the services of <br />22 an impound lot which benefits the public welfare, it is in the best interest of the City to <br />establish certain fees which accurately reflect the City's true costs for towing and storing <br />23 impounded vehicles; and <br />24 <br />25 WHEREAS, the City Council has determined that the fees proposed in this <br />Resolution are reasonable, fair and equitable in nature and is proportionately <br />26 representative of the costs incurred by the City for the described services; and <br />27 <br />28 WHEREAS, based on the information contained in this Resolution and all other <br />information presented to the City Council on this matter, the City Council desires to <br />1 <br />
