RESOLUTION NO. R-91-06 1 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, APPROVING A PIPELINE CROSSING AGREEMENT WITH 3 UNION PACIFIC RAILROAD COMPANY TO CONSTRUCT AND MAINTAIN A WATER PIPELINE EXTENSION 4 5 WHEREAS, the Union Pacific Railroad Company ("UPRR") owns certain property 6 which traverses the City of Colton ("City"); and 7 8 WHEREAS, the City wishes to construct a water pipeline extension across a portion 9 of the property owned by UPRR to provide water services to property located at 1700 East Steel 10 Road in the City of Colton in order for the property to be developed; and 11 12 WHEREAS, the City of Colton ("City") and have agreed to enter into a Pipeline 13 Crossing Agreement (the "Agreement") to allow construction of a water pipeline extension; and 14 15 WHEREAS, the Agreement will provide license forthe City to construct and maintain 16 a 12 -inch water pipeline across the UPRR property located at Mile Post 540.06 on the Yuma 17 Subdivision at or near Colton, San Bernardino County, California; and 18 19 WHEREAS, the Agreement has been negotiated to the satisfaction of all parties and 20 the City Council, desires to adopt this Resolution as written evidence of its approval of the 21 Agreement. 22 23 BE IT NOW THEREFORE RESOLVED AS FOLLOWS: 24 25 26 1. Approval of Pipeline Crossing Agreement. The City Council of the City of 27 Colton hereby approves the "Pipeline Crossing Agreement" between the City and Union Pacific 28 Railroad Company, attached hereto as Exhibit "A" and incorporated herein by reference, and authorizes the City Manager to execute the Agreement on behalf of the City. 1
