1 RESOLUTION NO. R-56-07 <br />2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />3 CALIFORNIA, DECLARING ITS INTENTION TO VACATE A PORTION OF <br />THE PUBLIC RIGHT OF WAY LOCATED AT `K' STREET, SOUTH OF THE <br />4 SOUTHERN PACIFIC RAILROAD TRACKS, BETWEEN 7T" STREET AND <br />LA CADENA DRIVE, PURSUANT TO STREETS AND HIGHWAYS CODE <br />5 SECTION 8300 ET SEQ. <br />6 WHEREAS, the City of Colton ("City") holds a right-of-way for street and public utility <br />7 <br />purposes over, under and upon that portion of or a public right-of-way known as `K' Street, south of <br />8 the Southern Pacific Railroad tracks, between 7th Street and La Cadena Drive, measuring <br />9 <br />approximately eighty (80) feet wide and three hundred seventy (370) feet long (hereinafter <br />10 referenced as "Portion of `K' Street") and more fully described and depicted in Exhibit "A" attached <br />11 <br />hereto and incorporated herein by reference; and <br />12 WHEREAS, the nature of existing planned development patterns for the vicinity of the <br />13 <br />Portion of `K' Street have rendered the Portion of `K' Street unnecessary for street and highway <br />14 <br />purposes; and <br />15 WHEREAS, the City received a request from the San Salvador Catholic Church for the <br />16 <br />proposed vacation of the Portion of `K' Street; and <br />17 WHEREAS, the San Salvador Catholic Church owns seven (7) parcels of land on `K' Street <br />18 <br />and no other property owners would be affected by the proposed vacation; and <br />19 WHEREAS, the vacation of the Portion of `K' Street would provide an extension to the <br />20 <br />parking lot for the San Salvador Catholic Church; <br />21 WHEREAS, the Portion of 'K' Street is not required for public right of way purposes and is <br />22 <br />unnecessary for present or prospective public use; and <br />23 WHEREAS, this vacation of the Portion of `K' Street is made pursuant to the requirements of <br />24 <br />California Streets and Highways Code, Division 9. - Change of Grade and Vacation, Part 3. - Public <br />25 <br />Streets, Highways, and Service Easements Vacation Law (Streets & Highways Code sections 8300 <br />26 <br />et seg.), Chapter 3. — General Vacation Procedure; and <br />27 WHEREAS, there are existing easements for public utilities in this Portion of 'K' Street and <br />28 appurtenant rights thereto will be reserved for the City in accordance with California Streets and <br />Highways Code Section 8340; and <br />
