Sotelo, City Manage445:� <br />SUBJECT: Payment to City of Victorville of $2,645 as Colton's Date: July 9, 1990 <br />share of expense to assert claim on San Bernardino County <br />for share of court fines and forfeitures. <br />Background Facts <br />Colton police make arrests. Criminal cases are filed in the County Court. <br />Defendants pay fines. Defendants post bail which is forfeited. San <br />Bernardino County collects these fines and forfeitures. State law <br />provides that Colton is entitled to a share of that money from cases originating <br />in Colton. Because it was believed that San Bernardino County has not paid <br />Colton as required, Colton joined with the other cities of the county in <br />bringing a lawsuit against the County. The purpose of the lawsuit was to <br />establish our claim that the County was wrong in how it divided the money <br />with the cities, including Colton. The cities won the lawsuit. The court <br />ruled in favor of the cities, but the amount owed has not been determined. <br />Victorville is acting for all of the cities in providing financial services. <br />Victorville has billed Colton $2,645 as Colton's share of the legal expenses. <br />Budget Impact: $2,645 <br />Environment Effect: none <br />Options/Alternatives: None.
