City Clerk LEGAL SERVICES AGREEMENT ORIGINAL 1. IDENTIFICATION OF PARTIES. This agreement is made between, AMY MARIE YORK, hereinafter referred to as "Attorney", and "City of Colton" hereinafter referred to as "Client". 2. AUTHORIZED REPRESENTATIVE OF CLIENT. Client designates, Jaime Aguilera, Director of Community Development Department, as the authorized representative to direct Attorney and to be the primary person to communicate with Attorney regarding the subject matter of Attorney's representation of Client under this Agreement. This designation is intended to establish a clear line of authority and to minimize potential uncertainty, but not to preclude communication between Attorney and other representatives of Client. 3. LEGAL SERVICES TO BE PROVIDED. The legal services to be provided by Attorney to Client are as follows: Attorney will conduct legal research and interpretation of the City of Colton's Mobilehome Rent Control Ordinance, be available for consultations, conferences, presentations, review documents, write opinion letters, and, provide instructions to the Rent Review Commission in the initial stages of organization and thereafter, when necessary. 4. LEGAL SERVICES SPECIFICALLY EXCLUDED. Legal services that are not to be provided by Attorney under this agreement specifically include, but are not limited to, the following: Consultations beyond those provided in Paragraph 3 of this agreement, review of documents and legal research beyond that provided in Paragraph 3, and any litigation. If Client wishes Attorney to provide any legal services not to be provided under this agreement, a separate written agreement between Client and Attorney will be required. 5. RESPONSIBILITIES OF ATTORNEY AND CLIENT. Attorney will perform the legal services called for under this agreement, keep Client informed of progress and developments, and respond promptly to Client's inquiries and communications. Client will be truthful and cooperative with Attorney; keep Attorney reasonably informed of developments and timely make any payments required by this Agreement. 6. ATTORNEY'S FEES. Client will pay to Attorney the sum of $65.00 per hour for attorney's fees, for the first forty (40) hours of legal services rendered, and thereafter, Client will pay to Attorney the sum of $85.00 per hour for attorney's fees for the legal services provided under this agreement.
