CITY OF COLTON AGENDA REPORT For Council Meeting of May 15, 1990 TO: Honorable Mayor and City Council FROM: Gale A. Drews, Electric Utility Director SUBJECT: APPROVAL OF FIRST AMENDMENT TO LAKE Date: ELSINORE PUMPED STORAGE STUDY COST SHARING AGREEMENT 5/7/90 A copy of the original Agreement and this First Amendment are on file in the City Clerk's office for your review along with the cover letter from the Law Offices of Rourke & Woodruff, signed by Attorney David A. DeBerry, asking that we obtain Council's approval for this change. The "Parties" in this Agreement are the City of Anaheim, the City of Azusa, the City of Ba4nning, the City of Colton, and the City of Riverside, and they are asking to amend the Agreement as stated in Sections A, X1.1, and A.2 in the First Amendment to the Agreement as follows: A. The Parties have determined that the cost sharing percentages stated in the original Lake Elsinore Pumped Storage Study Cost Sharing Agreement should be changed to reflect more accurate data used for determining the Parties, respective cost sharing percentages. THEREFORE, the Parties hereby agree as follows: 1. Section 7.1 of the Lake Elsinore Pumped Storage Study Cost Sharing Agreement is amended as follows: "7.1 The Parties agree to share the cost of the work to be performed by Tudor Engineer- ing Company and the Agent's expenses incurred pursuant to subsections 6.1 and 6.2 according to the following percentages: Anaheim 50.3%; Azusa 4.5%; Banning 2.5%; Colton 5.0%; and Riverside 37.7%. 2. The Parties agree to execute this Amendment in counterpart. RECOMMENDATION: Staff recommends Council approval for the Electric Utility Director to sign the First Amendment to the Lake Elsinore Pumped Storage Study Cost Sharing Agreement.
