Gabriel, Economic Development Director i4w� SUBJECT: CONSIDERATION AND APPROVAL OF RESOLUTION MAKING Date: August 16, 1994 FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF CERTAIN RIGHT-OF-WAY IMPROVEMENTS FOR THE SANTA ANA RIVER REDEVELOPMENT PROJECT AREA Background The Redevelopment Agency has advertised for public bids for construction and installation of water, sewer and overlay improvements on Oliver Holmes Road in the Santa Ana River Redevelopment Project Area. Bid opening to select the contractor for this project is scheduled for August 17, 1994. Discussion Although Oliver Holmes Road is a private street, it is open for use by the general public as a public right-of-way, and the improvements made by the Agency will be publicly owned and not dedicated or conveyed to any private individuals. Pursuant to Section 33445 of Health and Safety Code, redevelopment agencies may, with the consent of the legislative body, pay all or a part of the cost of installation and construction of any building, facility, structure, or other improvement which is publicly owned if the legislative body makes certain determinations. The attached Resolution makes findings and determinations authorizing the Redevelopment Agency for the City of Colton to provide the public improvements on Oliver Holmes Road. It is necessary that the City Council approve the attached Resolution prior to the Agency taking similar action and commencing construction of the improvements. Financial Impact There is no financial impact, funds have been appropriated by the Agency in both the FY's 93-94 and 94-95 budgets. Recommendation Staff recommends that the City Council adopt the attached Resolution making findings and determinations as to the benefit of certain right-of-way improvements for the Santa Ana River Redevelopment Project Area.
