RAMOS, CmC <br />City Clerk <br />SUBJECT: CONFLICT OF INTEREST CODE 1994 BIENNIAL UPDATE <br />Background: <br />The Political Reform Act requires every local governmental agency to review its conflict of <br />interest code biennially to determine if it is accurate and up-to-date or, alternatively, that the <br />code must be amended. Once the determination has been made a notice must be submitted to <br />the City Council in October of even -numbered years. <br />Discussion: <br />Each department was asked to review its individual code to determine who within their <br />department should be designated in the code. In order to make this decision the Department <br />Director took into consideration who within their department makes or participates in the making <br />of governmental decisions. To aid the Department Directors, the most common types of changes <br />which may have occurred which would warrant an amendment were provided and are as follows: <br />The addition of positions, including consultants, to the appendix of the code which <br />involve the making or participation in the making of decisions which may foreseeably <br />have a material effect on any financial interest. <br />The addition, deletion or modification of the specific types of investments, business <br />positions, interests in real property and sources of income which are reportable for the <br />designated positions (disclosure categories). <br />A determination that certain designated positions (including applicable consultants) <br />manage public investments and should be deleted from the list of designated positions <br />because they file the form 721 pursuant to Government Code Section 87200. <br />The reclassification, renaming or deletion of previously designated positions. <br />The disclosure category portion does not require the disclosure of business positions. <br />Section 87302 was amended in 1987 to require codes to specifically require the disclosure <br />of business positions. <br />4bWM0?0 <br />.'0 <br />
