Lavin, Water Utilities Manager *Ipr <br />SUBJECT: Date: <br />Approval of Resolution to Participate in <br />County of San Bernardino Assessment District <br />in a erally Mandated NPDES Stormwater Program <br />BACKGROUND <br />The Federal Environmental Protection Agency (EPA) has mandated that a National <br />Pollutant Discharge Elimination Stormwater (NPDES) Program will be implemented <br />by the local governments discharging stormwater into the Nation's waterways. The <br />County of San Bernardino has been permitted by the Santa Ana Regional Water <br />Quality Control Board to discharge into the Santa Ana River. The City of Colton is <br />one of 16 co -permittees under the County's permit. <br />DISCUSSION: <br />The City Manager at the time of the City becoming a co -permittee directed all costs <br />to be paid from the Wastewater funds. Each year the cost to participate in the <br />County NPDES Stormwater has increased. The County is now proposing a County- <br />wide Assessment District for the collection of funds to pay for the cost of operating <br />the NPDES Stormwater Program. The County has requested each City to adopt a <br />Resolution approving the formation of a County -wide Assessment District. <br />Each improved parcel (excluded are all tax exempt properties and vacant land) in <br />the County will be assessed a fee based upon the land usage. Single family <br />residences will be assessed less than commercial/industrial parcels. The estimated <br />cost for a single family residence is $5/year. Commercial/Industrial will be <br />$10/year. The City may include its costs to operate the NPDES Stormwater <br />Program. The City's street sweeping and storm drain cleaning programs qualify as <br />NPDES Stormwater costs. Also, the capital improvement costs to construct new <br />storm drains may be included in the assessment. Kennedy -Jenks, Consultants will <br />include the City's NPDES Stormwater costs in the Sewer Rate Study being prepared <br />by them. <br />Attachments: <br />Page 1 of <br />Item No. <br />
