Clarke, Electric Utility Director DATE: 09/26/94 <br />SUBJECT: AUTHORIZE ELECTRIC UTILITY DIRECTOR TO ACQUIRE <br />VARIOUS EASEMENTS AND RIGHTS-OF-WAY FOR <br />TRANSMISSION AND DISTRIBUTION LINES FOR THE NEW <br />SUBSTATION AND TRANSMISSION FACILITIES AND MAKE <br />PAYMENTS AT A PRICE EQUAL TO, OR LESS THAN APPRAISED <br />VALUES <br />BACKGROUND <br />Staff, along with its consultants, is in the process of negotiating with a number of property owners <br />to acquire a number of easements and rights-of-way for proposed transmission and distribution <br />lines. A portion of rights-of-way and easements, and swapping of lands, was agreed upon between <br />the City and CalMat Properties, Inc., (CalMat), and submitted to the City Council for its approval, <br />execution, and implementation of the agreement with CalMat. <br />STATEMENT OF THE PROBLEM <br />There are over twenty parcels involved in acquiring the rest of the rights-of-way and easements <br />from a number of property owners. To negotiate the agreed upon price with individual property <br />owners, bring to the City Council for its approval, and make payments to these property owners is <br />a long process and very time-consuming to settle individually. The price of some parcels is <br />considerably low and it is cumbersome to go through the process. Then the property owners have <br />to wait a long time to get their payment. Further, any unsuccessful negotiation with any of the <br />owners may require re-routing of the line and could further delay the decision and settlement <br />process to complete the planning and design of the transmission line. <br />ALTERNATIVES <br />After each settlement of the agreement for individual parcels with the property owners, the <br />Department would come back to the City Council for its approval. The process would be time- <br />consuming and cumbersome to complete the acquisition of all rights-of-way and complete the <br />design in time. <br />Page 1 of 2 Item No. <br />
