R-79-07 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON OVERTURNING THE PLANNING COMMISSION'S <br />DENIAL OF AN APPLICATION FOR DESIGN REVIEW, TPM <br />#18647, SIGN APPLICATION AND ENVIRONMENTAL <br />ASSESSMENT FOR THE PROPOSED CONSTRUCTION OF AN <br />EQUIPMENT SALES, RENTALS, PAINTING AND REPAIRS <br />FACILITY; A CONDITIONAL USE PERMIT FOR THE SALE OF <br />DIESEL, GASOLINE AND PROPANE RELATED TO EQUIPMENT <br />RENTALS AND A FREEWAY ORIENTED SIGN FOR FILE <br />INDEX NO. DAP -000-689, FOR PROPERTY LOCATED AT THE <br />NORTHEAST CORNER OF MAIN STREET AND IOWA AVENUE <br />WHEREAS, Watts Investments ("Applicant") filed an application (File No. DAP - <br />000 -689) requesting approval of design review, TPM #18647, Sign Application, and <br />Environmental Assessment for the proposed construction of an equipment sales, rentals, painting <br />and repairs facility; a Conditional Use Permit for the sale of diesel, gasoline and propane and for <br />a freeway -oriented sign ("Application" or the "Project") for property located at the Northeast <br />Corner of Main Street and Iowa Avenue, Assessor's Parcel Nos. 1167-111-01, 1167-111-02 and <br />1167-111-03, in the City of Colton, County of San Bernardino ("Subject Site"); and <br />WHEREAS, it is the intent of the Applicant that the proposed Project be utilized as <br />the Inland Empire central office for the Sunstate Equipment Rental business; and <br />WHEREAS, the Project was considered and reviewed by the City Design Review <br />Committee and, on April 2, 2007, the Design Review Committee forwarded the Project to the <br />Planning Commission of the City of Colton ("Planning Commission") without recommendation, <br />based on the Committee's concern with the location of the Project at a major entryway leading <br />into the City; and <br />WHEREAS, on May 8, 2007, the Planning Commission conducted a duly noticed <br />public hearing on the Application at which time all persons wishing to testify in connection with <br />the proposed Application were heard, and the Application was comprehensively reviewed; and <br />RVPUB\HSHANE\733624.2 - 1 - <br />
